PSD's can be opened in gimp and other programs.
Is this just scripting or a plug in for PS?
I'm assuming you'll just be moving the parts around on layers.
Also I believe the camera and soda scenario is incorrect, making a copy of copyrighted material dosent make it your work just a copy, the copyright holder is the sole owner of sad materiel and likenesses.

You can ask him on the subject if he gave a shit PMG would not be for public use it would most likely cost money to use or would be just for his use only. Not really, I asked a lot around and the creator gives unrestricted (if you dont sell) use unless stated otherwise. Otherwise no one would be allowed to use PMG. And This isn't really a program or anything, just some PSD templates, browsable by html. And yes moving parts around on layers is about how it works.

(CC)Creative commons and other(C)copyright laws are not the same, and there are many. With out knowing what his is asking around might not get you the correct legal answer.

Thank you. I've read A book on copy and trademark law and it said that fair use isn't really a law it just a defense in a lawsuit. The chance is very small we would get sued since we have all the fair use defenses for our project. There are apps that use PMG parts for comercial purposes and PMG cant do anything about it. But still ours is non comercial and we fall under fair use. But I just want this to be legit and fair for us, the users and the PMG team.

He dose shut them down, hes just a little slow. Attorneys aren't free and free phone apps and such he can only shut them down. Hes realy only concerned with the ones that are in direct conflict with him.
Not trying to be a douchebag but its found in sections 107 through 118 of the copyright law (title 17, U. S. Code). I believe this would fall under #4. The effect would be your taking people away from his app with his own work.

I dont know how much of that is true if both parties are non comercial. It's difficult to understand and to apply. Mainly because It's to subjective. I'll just have to get permission. Their disclaimer is a bit blurry. It says you can use their parts if you credit them for it.
