DescriptionWhile I was working on my Shinerai drawing, looking at the same character all day got old really fast. I took an opportunity to chill out by drawing a new design. I don't plan on using this design for anything, so I thought I'd give it to someone who will love and care for it!This time, I went a little further and made a reference sheet.
If you would like to bid on this character, you will receive a full resolution version of this ref. I will also probably throw in some other goodie doodles, depending on what the final bid ends up to be. I will not be using this design again, but I can't guarantee that some of the features won't show up in my other work (just happens sometimes, not every dragon is WHOLLY unique).
The bid starts at $20 and must increase in increments of at least $5. Please reply to the highest bid so that we can keep track.
The payment will be accepted via paypal only.
The auction will end at 11:30pm Thursday, September 4th, US Central Time.

Oh, Shin. You dont have to adjust your rules if you were comfortable with them how they were, I was just curious. I may not feel comfortable bidding on an IP I can't resell down the road but clearly your designs are of high demand even with that rule, so its not like you're losing out! c:

I understand the point that you're making but I don't feel that my request is unreasonable. This is only my second auction, so I really don't know the ropes; I'm just kind of doing the same thing I've seen other people do and I'm learning along the way. Obviously, I have no way of enforcing the "personal use only", but I feel that it is respectful to not sell a design after buying it from the original artist. If an individual is so concerned about having the ability to sell a design when they are done with it, I don't imagine they are really very interested in it in the first place. I might change this stipulation on future auctions (if there are any), depending on the feedback received, but please bear with me and my inexperience. I'm not a professional artist and I apologize if you are too uncomfortable to bid this time.

Hey Shinerai! I saw your poll and checked this out, to see this. I suggest this site: www.artpact.com/Contracts They have all the different types of agreements that the art industry should be using. It's a really informative site, even if only to use in stipulation. You are within your rights by the way. Like KattoTang said pretty standard.

To be honest, I'm pretty sure that the sale and resale of a design really can't be enforced because designs can't be owned or copyrighted in the first place. I just put it there because I thought it was respectful to not profit off of something you bought from someone. I definitely wont be making the request again because it isn't worth dealing with the attention. It's not a big deal to me anyway, since I'm just a hobby artist.

Mm, that's for contracted artwork, not for IPs. We are all fully aware of Shin's rights on her own artwork, what we are all referring to is the design(IP) itself. The character, not the art. Shin is in her rights to say it can't be sold, yes, but legally once it is purchased the DESIGN is the buyer's property and can be resold for any amount without penalty, was what I was trying to say.

If you want to get technical on it; I don't own the design to be selling it in the first place, because you can't copyright a design or a character.

That's not true at all. If you weren't new to this like you claim you'd know that that is just nonsense, no offense. IPs can be sold just like artwork can regardless on what you believe with the copyright laws. There are copyright laws that protect characters.

I am new to selling designs (this is my second time), though I have some slight familiarity with copyright. I certainly won't say I am an expert because I never really cared too much to get into it. I understand now that my mistake was the wording of my initial request. Not only was it vague but it was also worded in a way that would make it a law-binding contract. In retrospect (since my level of seriousness on this is far less than my words implied), I understand that what I should have done is simply request that the artist respectfully not profit off of the design that I was selling and, in good faith, believe that they would honor my request. That is good enough for me.
As I mentioned that I am not an expert in copyright, the experience I have is regarding an interaction I once had with another artist on dA. I was briefly familiarized with international copyright laws because she was attempting to copyright the wing design that she had created. If I remember correctly, the struggle that she had is that you can't actually copyright a design or a concept (at the time). What she ended up doing was creating a totally massive drawing where she drew her wing design in every pose she could imagine. After she finished, she officially copyrighted this drawing, which would henceforth mean that anyone drawing the wing design would be infringing upon the copyrighted work (which would include the pose which the person was drawing).
This is the only experience I have with copyright law and it occurred 8-9 years ago. I wholly concede that my knowledge is limited and that copyright law has likely changed since then. Even if it hasn't changed and even if I am correct in that you cannot copyright a design, it really doesn't make a difference to me. I fear that this whole conversation has portrayed me as someone who is uptight when it was really unintentional on my end. Some time yesterday evening, I removed the request from the description, so that other people are not confused or uncomfortable.

You're actually right, Shin. Copyright doesn't protect characters except in very specific circumstances. Technically, I could copy this character right now and there wouldn't be much you could do about it so long as I don't copy the actual picture... The rules of buying and selling characters is a fandom thing with no real legal basis. The entire business of it revolves around people agreeing to rules outside of actual copyright laws.

I figured that was the case. After all, if you could copyright characters, that would mean that artists profiting off of fan art (such as prints sold in artist alley at a convention, or similar) would be horribly illegal. Lord forbid someone copyright the first wolf character and enforce it. It makes sense to me that characters can't be copyrighted. The way you put adoptables is very accurate. As long as people are comfortable in participating, it seems very harmless and well received though c:

Yeah. Technically, profiting off of fanart is still illegal, especially in the case of trademarked characters, but most people turn a blind eye to it since it would cost more than it's worth to enforce it strictly. But your comment about the wolf...basically that, lol. You can't just make some random wolf character and then insist people can't make wolf characters that look the same. Even if you trademark your wolf, it only goes so far. Like Mickey Mouse is trademarked, but that doesn't mean I can't make black cartoon mice and sell prints of those. As long as I'm not copying his exact likeness (that is, Disney's style for him), then they have no legal grounds to do anything really.
With adoptables, it seems like it's mostly a thing of extending rights to someone else (usually to post the artwork of the character and use it for personal reasons), not outright selling rights...which is the same thing that usually happens with commissions. I don't think the commenter really knows the difference. But then, she probably also just doesn't care, since she seems to be really pissed off at me. Which is kinda funny it's not the other way around, what with her saying how it's a "rip off" and "stealing" to not allow resale, and then went on to say that people that do that are "selfish" and "stupid"...

Thank you! The pink area is a cross section of the wing, which has been removed to view the back of the dragon. It isn't naturally gone (though I guess the buyer can determine whether it is or isn't)
