Found it it is a Japanese Snow-bell tree [link]

It blooms the loveliest white flowers and the birds love the fruit

Bob's mom was just here, and when I showed her your picture of it (btw, she loved the bird!) ...and then the link and other pictures... she wants one, too ...and is pretty sure that she saw them for sale at Lowe's this year

You will love it for sure! It grows slowly and it branches out beautifully, perfect for shade. Ladybugs seems to be the only bugs attracted to it. Glad I was able to help, you're welcome.

Bob's mom says the purple ones are really pretty (apparently that's what she saw at Lowe's)... and the online images are cool ...and I'm a COLOR kinda person ...so it will probably be a purple one

Bob's worrying about it freezing... 'cos we're in USDA Hardiness Zone 5, and that's the northern most zone that it is stated to grow (zone 5-9)... but, I'm convincing him that since it IS deciduous, that it will probably make it, just like our plum tree, azalea, and star magnolia

The bird, I know for sure is a bush tit
The tree, I think it is a type of dogwood. Been trying forever to figure out exactly what type. I looked up pictures of trees with white blossoms and hanging acorns - no luck.
