I dunno. Vader is noticeably smaller than Harry, which indicates he's in the background and Harry is running away, toward the viewer. It also looks suspiciously like Hedwig is attacking Harry in response to Vader's hand gesture.
Even without all that, when I consider the way Snape was able to slap Harry around without breaking a sweat at the end of Book Six, I'm putting my money on the man in black.
