The nature of the deal was that the devil would take both their souls; in order for it to be made, both brothers would need to agree to it. But according to the storybook, Mugman said no, while Cuphead threw the dice onto the craps table, indicating agreement from only his side. Unless given permission, one member of a party is not aloud to make decisions on behalf of the others; especially when it comes to wagering their very souls.
In short, the brothers didn't both agree to the Devil's wager, therefore, that bet by default couldn't have been placed.
CUPHEAD LOST A ROLL TO THE DEVIL THAT HAD NO BETS ON IT.
All of this trouble could've been avoided had one of them realized this.
