I'm sorry but your wording got me a little confused, you think that because Hasbro hasn't said anything yet they won't send a C&D? How long has this project been underway? It must be bigger than I thought.

No, what I meant was, they hesitated with sending a C&D to the developers of Fighting is Magic, until the game was almost finished.
Legends of Equestria is in development now for about two years and has never got a cease and desist until now, even when Hasbro knows about the game.
But that must not mean that Hasbro allows the game.
It could still be that Hasbro is send a C&D when the game is almost complete, like they did it with Fighting is Magic.

Hmm...when you put it like that Hasbro is kind of an ass for waiting till the last second. :/ Anyway, I might have a theory for this. Hasbro has some pretty fierce copyright laws here in the U.S and I believe Legends of Equestria is Being made in New Zealand. (Can't remember for 100% certainty) Maybe the fact that it's simply not being created here in the U.S will make the difference? Different laws, less power over brand name, that sort of thing.

I know about this law. It's just, that it's not an copyright law, but a trademark law, which forces Hasbro to protect it's trademark when someone violates it, with the threat of losing the trademark when it does not take the necessary steps to protect it.
This law is the reason why Hasbro had to stop the development of Fighting is Magic.
But I think Hasbro is an ass for waiting so long with that.
To be honest, I can understand why they waited so long with that.
Hasbro is completely fan-friendly, it even pointed out several times that it's appreciating the creativity of bronies and everything they do.
Try to imagine you're Hasbro and you see how some bronies put together a great fangame, with much effort and love put into it, and you know the project will cease for exist, because of this trademark law.
I think, the responsible officials at Hasbro just haven't brought it over their heart, to stop the project earlier, than in the last possible moment.
We should not forget that humans work at this company, not soulless money greedy monster, like in many other companies, who are total copyright nazis.
Maybe it even waited almost until the completion of the game, in hope, that there will be somehow a chance one day for mane six, to bring the game out either, despite this stupid law.
Just assume this case:
"Someone" is getting somehow the almost completed game from Mane Six, and is publishing it anonymously in the internet.
No one could accuse Hasbro than that it is not protecting it's trademark and also no one could blame Mane Six.
Maybe Hasbro hoped for this to happen, with waiting until the game is almost finished.
Who knows?

My mistake for getting the two laws mixed up, but you know what I meant 
As for Mane6... I heard that the main reason Mane6 got the cease and desist order was because they had a "Hot Coffee" mod. 
I'm a supporter of fan made games so I really hope that things work out for Mane6 and the creators of Legends of Equestria. 
Oh and I hate to ask but would you mind switching this to notes? Most people I've met don't really care for people having in depth conversations like this on their posts.

I don't think there should be clashes.
We can't blame Hasbro for a stupid law, a law that is that stupid, that Hasbro ist not even allowed to decide for itself what it wants to do with this trademark and what not.
And we shouldn't.
The Hot Coffee mode in FiM ist just a rumor from an unthrusty news page.
There never was one.
If there would and if it would be the reason for the C&D, they wouldn't have stopped the development on the original game, but only removed this mode.
I know that Mane 6 isn't out of business, but what you know is not fully true.
Lauren Faust works with them on the game, since short after the C&D, and is creating new original characters for them.
But no ponies.
The pony game is dead.
I just wonder if they still have the almost finished version of the original FiM somewhere.
If there ever is an opportunity for that ( a change in the law, a loophole found in the law) they could finishing and releasing it then one day.

You must have better sources than I do. I'm still pretty sure that Mane6 is releasing the game with created pony characters though. I saw a silhouette of a character that was tall and walked on four legs. I keep getting stuff wrong though so I'm probably off on this to.

Mane Six itself pointed out on their homepage that they will still have four-legged creatures with hooves for their game, with the same style like the ponies, but no ponies.
Some speculate that Lauren Faust is drawing lamas or alpacas for them.

I doubt not that this will become a good game too and I also not doubt that the drawedfrom Lauren will look fantastic, but since there are no ponies, I'm not interested in the game anymore.
Cause ponies was the reason I followed it.
Until there's no legal way to get the game done with ponies, we only can play a leaked version of it.

According to Lauren Faust, Pinkie was originally planned as pony who get's super powers when she eats enough sugar, so she would break through doors all the time and the Cakes had to buy a new door every week.

its verry simple, all ponies have a magical field that manifests diferantly for each kind.
For earth ponies it helps plants grow, for pegasi it reduces their weight and removes the need for streamlining or aerodynamics.
