Yeah, I have no problem with people using my icon, as long as you tell people that I made it. I am using Photoshop 7 (the all-mighty god) to make my gifs. I usually make them much larger than they need to be and then shrink them, I find that they always look better that way. ^^

You can buy it, or you can get a copy off a friend or something like that. I think Adobe has a trial version available on their website, but I am not sure....
