I wouldn't like to say the rules are "suggestions", but in cases like these, the site doesn't give me much options to make users follow them as i asked to. So following them is up to people's morals. I I wouldn't ask them to take it down but rather comment to let it clear that they don't have my permission

Technically, you could file different formal complaints against them for copyright infringement. DeviantArt provides basic copyright by default, if you look on Deviations.
