  What are SOPA and PIPA?



The United States Congress is proposing two laws that address the problem of wide-scale unlicensed distribution on the Internet of motion pictures, songs, trademarked goods, and patented pharmaceuticals.  

  • One of the proposals is called SOPA (Stop Online Piracy Act) and would direct search engines in the United States to block Internet sites outside the United States that are primarily engaged in distributing unlicensed content.
  • Another proposal called PIPA (Protect IP Act) would block websites located in the United States as well.
  • The Obama administration is putting a stop to these proposals.  It wants the Internet companies and the content companies to get together and come up with more functional and less destructive solutions.


      What would happen?



    In both proposals, if they became law, the government of the United States would determine on application if a website was primarily engaged in unlicensed distribution.  A court might hold a hearing but only if the people who run the website showed up.  Otherwise, the site would be blocked by an order directing all websites in the United States with search capabilities or links to refuse to resolve any results or clicks to the blocked address.

    Blocking addresses is hard to do without damaging every address on the Internet.  The blocking methods suggested in these two proposals would completely confuse existing Internet functions. They would encourage multiple hacks to get around the blocks (and the proposals, it turns out, would be ineffective against very simple work-arounds).  Maybe a few copyrights get saved but the price is opening massive wormholes in the Internet permitting hackers to re-direct traffic all over the place -- to malware, spyware, and phishing operations.


      Who's affected by these proposals?



    Identifying sites that "primarily" infringe on copyrights is full of complexity. Nobody agrees on what "primarily" means. Many sites like Wikileaks and other activist, political, and cultural websites need to copy material that is copyrighted by others who oppose their goals in order to criticize them or to bring important documents into the light.  Some organizations, particularly political and religious ones, would use these laws if they were passed to try to block sites that republish controversial writings of a dictator or of a priest that they would prefer to keep under wraps.

    Even harmless Internet behavior can be "primarily" an infringing activity: for example, a Tumblr account with still frames taken off of Glee. The unique address of the Tumblr account potentially could be blocked under these proposed laws.  


      What are the implications of SOPA?



    SOPA, which would only block websites outside the United States, is a complete embarrassment to a country that has avidly supported the freedom of all peoples to express themselves openly particularly in the face of oppressive regimes.  The role of the Internet in populist liberation movements is well-known and the tools used by these movements come from the people and companies that built the Internet and the Web -- not from motion picture companies and sellers of consumer goods.  If the United States blocks websites over a Tom Cruise movie or a Rihanna song, other countries are certain to be encouraged by this to find cultural and political reasons to block websites from the Unites States and will refuse to open their borders, virtual or otherwise.

    The Internet that has connected the world would become disconnected under these dangerous proposals.

    The Internet is fragile.  The worldwide protection of copyrights and trademarked goods is extensive and the laws for them already are powerful. By comparison, laws that protect an open Internet are few and far between.

    The compromises that the White House calls for are going to be very difficult to reach.  The motion picture studios and record companies are getting actors, directors, and singers to support SOPA and similar measures and have announced that they are not going to back down.  Internet users are up in arms and protests are scheduled for January 18, 2012.


      SOPA and the deviantART community



    The community on deviantART is in a special position.  Our members make art -- copyrighted content -- and they want it to be protected.  But everyone on deviantART uses the Internet to expose themselves, their work and sometimes their souls to the world and we depend on an open platform for the very existence of the community.  

    DeviantART as a site and as a company promotes the rights of artists.  However, SOPA and PIPA are poor "solutions", and we should all work towards other ways in which to resolve valid concerns about infringing conduct on the Internet that do not potentially harm free speech or the Internet itself.

    Take a look at the deviantART front page using "Newest" in the Browse to see a remarkable community protest of SOPA and PIPA.

    As of January 20th, it now seems that SOPA and PIPA will not move forward through Congress.  As previously mentioned, the White House opposed these bills before the protest began in earnest this past Wednesday. The White House reflects the position of the majority of the Democratic Party. Last night at the Republican Party primary debate in South Carolina (watch a video clip here ) all of the candidates came out against the bills. The frontrunner, Mitt Romney, was particularly forceful on the notion of an open Internet.  In the video you can hear the crowd reactions as being quite negative towards SOPA and PIPA.  So both of the major U.S. political parties are now aligned as against the proposals.

    Meanwhile, the head of the Motion Picture Association of America has called for the White House to intervene and help big content and big tech reach compromises. See this New York Times article for more information about the issue.

    Given the extraordinary grass-roots response to these proposals, almost overwhelmingly negative as reflected in all of the comments to this Journal and others on deviantART, this is a political hot potato everyone in politics will now want to stay away from.

    its garbage. ill personally smash the person that puts this through. Why don't we all just crawl into a jar and put the lid on. Take away the right to do what you want the people that do this are going to start a civil war. Artists vs the assholes. The creative vs the insecure. These are people that don't get happiness and want to take from the people that are.
    All my life i have grown up with people wanting to place power over me and take from me my love of life. We all have. They think its better. They think its right. The scary thing about it, its all of us that do it. Sure we don't take away power like the people that have the power to, but we all look at each other and feel the fear of judgment and the glance from eyes that want to label you in your freedom. In this moment we all take power in little amounts from each other and forget to just smile and wave and be happy for the person that is different and looks the way they want.

    The system is us. We are the system, and fear is the engine in which we all know and have been in since we were born. It's the school we were in and are in. It's the food we take that causes us to be agitated as more and more processed sugars and chemicals we ingest that put us in the state of mind where we can no longer feel calm and at peace. We are what we are, but taking away the art and creativity will be just a start. The internet is the connection to the truth. It allows us the freedom to see what is out their and learn from other instantly. Growing in any way we like. We must learn and seek out our own path and be who we want, and be what we want. We know right from wrong, but as the computer age allows the people of this world to sit at home and not seek adventure we are creating people that hide behind the keyboard and are fearful to seek the adventure within. Deviant art is an amazing place where i love to sit and see the great many pieces of art that you all have done and smile at the creativity within you.

    I'm just one person. As you are as well. But we have a choice to stand for whatever we like. All i say is this. Know that we are who we are because we chose to be pushed from the people in power. Vote and change it if you don't like it. Stand and yell at the top of your lungs if you want to be heard. Let your voice sing and cry when you like as no other person can give you what you already have inside of yourself and stand for yourself and you will see the people that will stand, sing, cry and love with you.

    We all have a heart. And we all have a brain. What we don't do and should do more is relate to each other, so we can see that we are all the same. You are not your color, you are not your race, you are the same as me and the other people that populate this world. You bleed, you have bones, and you have flesh just like me. So why is it so hard to look at yourself and admit you are weak to others? Well thats for you to decide, but i'm weak because i was raised by parents who were weak, but i looked up to them as perfect and imprinted their weaknesses. That doesn't mean you are weak, it only means you have to learn your own strength within yourself, and stand strong for yourself and the people that chose to stay in their own weakness.

    I don't know everything, but i know who i am. And ill be damned if i let some fat bastard take my freedom of creativity from me. This i will die for. I'm not weak, or afraid to say that i grew up with an abusive alcoholic dad that in turn had one himself. I can understand that the abuse that i went through wasn't really my dad because we are not perfect people. The sooner we all can accept that we have a choice within ourselves, the sooner we can smile in the moment and love and accept each other for who we are.

    It'll really suck if this crap passes. I'm all against SOPA and PIPA!

    One thing that'll happen if this does pass, internet users will just hack and reprogram whatever B.S. they use to block the content. All they'd have to do is make a website like a free proxy server website that diverts the SOPA and PIPA programs so we can have uninterrupted internet usage. Or better yet a program for computers that do that very thing.

    250 or so years ago, this system worked. Now, it's all falling apart - just look at the world around us . . . it's a pity

    Yet radically changing it would be hard, too, if you think about it; trapped in between two walls, unable to get out . . . and who thought of this bill? It's the beginnings of censorship, right there.

    Internet is a a really huge and wide platform, where we can find, watch, hear, and do so many things. But as technology keeps on progress, internet is changing too. There's no frontier. So, we can find freedom in it.
    However, it's not that internet is worldwide, easy, and isn't controled by many strict laws that we can do anything on. See how websites becomes: they're invaded by ads, popup. (and sorry for the language: WTF with thoses stupids ads like "cougar women" "wanna see me nude?" STOP it now!!) Because there's illegal contents, there's more and more people who dll them, and share them after, use this illegal stuffs to make money on the work of others, that make companies, gorvernment react. "Protection", I think, is the word which echoes well to the primary idea of HADOPI, SOPA, PIPA... But, the reaction is axagerate, and more an overeaction than a reaction.
    To protect, and moderate when it's "necessary" are okay. To exagerate, and to be caged after are the worst thing to do.

    Democracy is based on laws to secure freedom for everyone.
    Laws are created to organizise and make it possible.
    However, everyone knows, excess is always not good.
    And not only for SOPA and PIPA.

    Hawaii's legislature is weighing an unprecedented proposal to curb the privacy of Aloha State residents: requiring Internet providers to keep track of every Web site their customers visit.

    Its House of Representatives has scheduled a hearing this morning on a new bill (PDF) requiring the creation of virtual dossiers on state residents. The measure, H.B. 2288, says "Internet destination history information" and "subscriber's information" such as name and address must be saved for two years.
