Description
I had a lot of fun painting this picture. It was not an ACTUAL reference from a game in terms of composition but different elements from mario have been thrown in. We have opened up a new store where my own (and others) artwork is now available for purchase if you're interested! This & more will be coming every week so stay tuned!!
This is for an upcoming project within 8BitEgo.

Can I ask you a question. Why are you not piss off at people, who misuse your images by downloading, for example this image or any other images, that you created. Other people are using these images for their own and telling people that they own this image. Do you agree that your images are copyrighted protected. Yes or No? Plus they are not giving you credit, when they are use your images for creating a new image inside yours. If you agree that your images are copyrighted protected why are you not enforcing your rights over these images? Another question: Why are you using a higher resolution on your images, for example 1488×1052 at 1.3 MB?
Now I sent you a private message on Facebook, if I can use this image for commercial usage. You never responded back to my message. I sent the message on March 3/2013. I was also welling to go the extra distance, by paying you a licence fee in using this image. It looks like you do not want to be compensated for your hard work in designing the image. Is this true or false?
Now I regret that I have to post my argument this form, but I have no choice. Please respond to my questions on this subject.
Thank You

Unfortunately I can't control who decides to try and fob this off as their own work and/or stop them. Majority of the stuff that I do that gets blogged around like this is all linked back to me and a lot of people who spot my work often help out and let me know which is awesome.
The only reason its that res is so people can zoom in on it if they want to. If you try stretching it to A3/A2 size it will get distorted and lose its detail I am pretty sure. To be honest when I posted this I didn't even realise about that stuff as I didn't expect it to get popular.
As for the Facebook message, I don't remember seeing it and didn't ignore you on purpose. I just looked through my messages and there is nothing from you on that date?? Of course I want to be compensated if it is used. But I don't know how to search for this image on peoples profiles who are trying to make it their own and stop people stealing it.
No worries on posting here, I don't mind.
Thanks

Thank You responding back to my last message.
But I have to say that one of your statements, "To be honest when I posted this I didn't even realise about that stuff as I didn't expect it to get popular". To me or to anyone else who reads this statement alone, would be scratching their heads because you are telling use, that your rights under UK Copyright laws don't matter. Do you realize that any corporation or any person/ persons could use this image or any other image for their own and you do not get paid for your ideas and creativities? Don't you think that is wrong? There are ways to protect your work. For example, place a large watermark "copyright symbol" across your images or write the word "copyright". In big bold letters. This would protect your work.I know for sure that other people and web sites, that are using your images for their own and allowing other people to use this image.

What on Earth are you talking about? This guy is saying that this work IS HIS but he's not exactly going to spend his days trawling the internet to sue every kid who uses this as a background on their MySpace or whatever. However, I'm sure if somebody was making thousands off this piece through merchandising or whatever, *JoshSummana would take appropriate action.
Under UK law, anything created with a significant degree of effort is copyrighted to the creator unless the creator has signed a contract stating otherwise. Just because *JoshSummana says, "Hey I made this but I can't sue every single person on the internet who steals my image." It doesn't mean he's giving away his copyright.
You don't need to slap fat copyright watermarks and make declarations that the work belongs to you in order to retain copyright. In fact, I find that practice very off-putting, even as an artist.
I'm not even entirely sure what your point was, but I had to correct you on the copyright remark there.

I agree with you that under UK Copyright laws, that the Artist work is protected. But it is up to the Artist to make sure his/ her work is protected for example: Register his/ her work, putting a large watermark across the image and so on.
Let me ask you a question. Should you be paid for your work if someone is going to use your image for commercial usage? I have seen people, misuse this image from other countries and they where getting paid for their services. I also seen other web sites misuse this image. After you read this paragraph, would you agree that you should go the extra distance in protected your work?

Firstly, you don't need to register copyright for reasons I stated in my first post. Secondly, people will abuse your images no matter what you do with them. Putting a big, obscene watermark over the image will just make it look hideous and won't stop anyone with a basic knowledge of photoshop or someone who wishes to trace the work.
Finally, as :devjoshsummanara: stated previously, he relies on the aid of his fans to alert him of any unlawful use of his images. I see you claiming that there are people out there making money off this but you have yet to provide any links. Perhaps you could help him out there? Your heart is in the right place, but advising that he slap a translucten smear all over his work is detrimental to the artist IMO.

I beg to differ on your first statement, "Firstly, you don't need to register copyright". If you go to, [link] you will notice that there is a registration service, that can help you to protect your art work. By going the extra distance you are insuring that your work is protected i.e registering your work, large watermarks and reducing your image size when you up load your image to deviontArt.
Yes I agree people will abuse your art work, if you do not go the extra distance. Like I stated in first paragraph. If you put a large watermark on your images, people will look twice before they misuse your images. Plus if you also stated that each image is registered at UK Copyright Services, they will not misuse your images because they do not want a lawsuit.
It is not my place to police, what other people are doing with Josh's images. All I can do is advice on how to protect his artwork. It is up to Josh, to go the extra distance in seeking out, who is abusing his art work and how to stop the abuse. I have given Josh, the tools to completion this task in protecting his work. But I will not give out names.

I'm simply going to respond to your link with this one. [link] There is no official registration of copyright and defacing your artwork with huge watermarks is silly imo. But that's just my opinion.

Gotta love how realistic everything looks.. I like your approach to the Piranha Plant, but the detail on the pipe really caught my eye; I love how rusted up it looks.
The vines surrounding the other pipe is also a nice touch. Great work and congrats for the DD.

Cool realistic effect with the grass. I like how you stick with the composition just enough for it to feel familiar.
