and i keep seeing it happen to other people too like,,, these adopts are completely innocent, adopt makers that base a design on a copyrighted character arent out there doing it to be a villain despite how people treat them for it. like its happening to really nice people too and theyre getting demonized for it and its super not cool??? like its an adopt, its not hurting anyone

well then its a good thing i wouldnt be selling them??? people make (and sell) adoptables based on canon characters all the time. there are callie and marie pacapillars that no one complained about. theres many many many many pokemon adopts, these a bagbean thats literally just breath of the wild link, there are pearl and marina sugarcoaties.

nintendo isnt going to come and sue any of us, relax

how about i make a character who's design is 90% stolen from your main character ?? i want to give it away to a friend of mine !! i'll give you credit and i won't sell it, so that means it's ok, right ?? oh wait, i'm not supposed to get permission first, am i ?? i forgot, my bad

that's just a silly way of thinking imo. these designs here are mostly created by someone else. you are so much more talented than this and your original designs are so much better, it just makes me sad

and it would be a problem if it was my character because they are mine and not a companies character that again, is public domain. my characters belong to me and me only, not a company. my characters are not public domain. this is why people are allowed to sell fandom merch, and this is why people are allowed to make designs based on the characters

the original designs aren going anywhere just because i made a couple splatoon designs for fun and gave them away. i dont understand why anyone has a problem with them seeing as i gave them away, not sold them, they are public domain, im the only one anyone has an issue with for doing it, i still make original designs, and im not taking credit for them. again, nintendos not gonna come and sue me for it so no ones getting hurt by these, just let them be

selling fanart is technically illegal according to the research i've done D X

and even if these kind of characters aren't illegal, you are still "giving away" designs somebody else put tons of effort into. the people that sell them are a lot more controversial, i'm not sure why everyone is targeting you in particular

Just because someone else is doing something wrong, that doesn't make it okay, morally acceptable, or even legal. I'm sorry, but that's extremely childish. None of those characters you mentioned are legal. I don't know why exactly they haven't been complained about as often, but they are still nonetheless not okay.
If it's illegal for me to, for example, take your character, turn it into a different species and call it a 'fan character' and then give it away then why is it okay to do it to someone who's as popular as Nintendo? I see all the time, people squabbling over the tiniest resemblances in ocs, but these character, exact ripoffs of popular character seem to get little to no backlash. It's not even to the point where it's inspired, it's literally the same character but the species is changed.

Maybe Nintendo doesn't care or won't care to take the time, money, and effort to sue such smaller scale people, but that still doesn't make it right. None of the characters are in public domain by the way, I don't know where you are getting this information.

Splatoon was released on May 28, 2015. It's very unlikely the designer has passed away as it's only been a few years. Regardless it would take several more years after that person's death to reach the public domain. AND in some cases it can be extended even more than that! Look at Mickey mouse for example, Walt Disney has been famously dead for many many years now.

Again, just because it's owned by a popular company or person, why does it make it okay to copy them? There is no difference what so ever.
So what if you say made for example, an animated series about your characters that eventually became extremely popular to the point where it's just as well known as Nintendo, would it be okay for me to copy your characters then? No, of course it wouldn't and I'm sure you'd be upset if I started selling them or trading them, or even just start giving them away, and again, not just a fan character, but a character that you made.
I don't know the case of every single person who makes merchandise for a specific franchise, but in some cases it's illegal and they have no permission to do so, and in other cases, the company gives them permission, or the company just doesn't have the time or effort to do so. If however, the merch becomes a problem for them and they start to become a competitor, occassionally, they might send a cease and desist but again, if it's a smaller artist usually they don't bother, but again, that doesn't make it okay to do any of this. It isn't.

Again, I know that this is a somewhat old post, but I really do hope to see less of this in the future.

Yeah, Nintendo's characters are NOT public domain, that's not what that means. If they were, people would be allowed to make and sell their own Splatoon video games. Nintendo's characters are protected under copyright and will be for at least seventy years.
