Description Hah.

A few years ago someone tried to buy a print of Aoi. Actually they purchased several, but one or two got declined. Reason? dA was foolish enough to say that my lovely Aoi infringed on copyright of some imaginary unspoken party.

OK. There are about a billion blue-haired girls. Long or short. And about 100 million anime girls named Aoi.

*sigh*

Dummies.

Aoi shall return again, but next time she will battle her nemesis: Epic Fail Games.

i don't think it was possible for them to get a complaint. instead the printer processor dude rejected the print. I told them it was a mistake. They sent me to the manager. The manager said "nope they are right, change her name a little bit".

OK that's dumb. You can't copyright a common name....

I agree that does seems odd. And it not like there another character with blue hair and animes eyes. Have the same name as your character. I mean there arent right?

This goes back to where you said "nothing is original". At this point you could imagine how many characters have blue hair AND are named Aoi in anime! I did a search about 3-4 years ago when this came up. There were at the time at least a dozen that I could find. Its kinda like having a character named Bob that has brown hair. There are so many out there its strange that someone would try to protect that combination.

I think there were a couple of leader Aoi characters, but dozen or more secondary/Tertiary characters with blue hair named Aoi. Thing is, none of them looked quite like her...I mean you could totally tell they were totally different art styles, hair styles etc etc.

I don't get dA sometimes.

Okay now i see the problem! I hate to admit it. But D.A is technally right here. If there are other character with Blue hair and Anime eyes,with the same name. Then you would be infringing on copyright. But the odd thing is like you said there plenty of characters out there,with similar trait. They should to received a copy strike warning. Maybe they didn't try to sell prints. Still it odd. If i may ask this question. What hash tags did you use?

We can say dA was playing it overly safe, since they could care less about a few prints.  They can decline what they want here. As it is their own service. But outside of their own print service, no they would be wrong.

Especially since there was no character they would pin the copyright to. You can't copyright overly generalized features. Not in the US or Japan. You can't copyright hair color, common names or even a style of art.

The tags would not be important. Blue-haired, swimsuit, boobs.

I've been doing art for decades now, and have formally taken art business practice classes and follow copyright cases over the years. There is no basis for dA line of reasoning.  It would be one thing if I named a character Spiderman, or used one of Peter Parker very specific outfits. But you couldn't copyright Peter, or a guy with spider abilities.

But sometimes real world examples work best. There are countless anime and manga with blue-haired characters named Aoi, and they aren't suing each other. There are tons of strawberry blondes named Ichigo too. Because its not copyright-able.

Your right you can't copyright a single characteristic. But what you can copy is the combination. I'm looking at the example of the other Aoi. You put in this art. Your Right your Aoi looks different then the others. I guess your right There playing it safe. I have an idea. Why not give her a hair accessories? Your using Daz3d right?

yeah Daz.

And good you see how there are so many ways to make a blue haired anime girl (named Aoi) that look different that I couldn't ever find which one she was infringing (supposedly). 

I see where you are going with the hair accessory. A single accessory could be her "signature" thing that be her gimmick. She used to have a cat necklace...maybe I find that and turn it into a hair piece ^_^

But we are good. They accepted the print after I removed her name from the title of the piece...After the print I just put her name back in the title...It just shows they were being flaky. I'll always remember the experience though, was annoying.

EDIT: Oh yeah, she prolly could use a last name...that would help I think. Just hate to force a last name after all these years.

Wait it was the name all along! I'm not surprise it kinda make sense. There are other Blue Hair Aoi. Even if your look different. And yes go for a hair accessory something that unique. Something that say it LarsMidnatt Aoi. If you got the cash i say pay an artist to draw you one. Then maybe hire a 3D modeler to make you one for Daz3d. It cheaper then you might think.
Me personally i go for a Collar or Choker

her first few renders had a choker with a metal cat on them.

it was cute. i could make my own accessory easy, stuff like that is simple. but I might dig up her choker after I finish these panels Im working on.

for the most part, you are right. 

There are certainly original arrangements of concepts and all that. But basic concepts like revenge stories or hair colors have been beaten to death.

Even The arrangements themselves aren't even original. Ever thoughts,ideas,characters,and things are not original. There all copies reference,and mixture of other things. But just cause it not original doesn't mean that they can't be good,great,and even unique. Case in point Marvel Deadpool. He is a direct copy of DC Deathstroke. Even Deadpool real name is a reference to Deathstroke real name.
