Thanks. To be honest I'm not quite sure, if Dreamworks are willing to enforce their copyright they will contact Etsy. It's annoying how all these laws and copyright make work seem quite pointless, all that effort for someone to say you can't sell it.

According to copyright law and the fair use clause (especially in regards to fan art), yes you are in violation. Toothless and the Pokemon and any other copyrighted or trademarked character that you create art of and then proceed to sell constitute a violation of copyright law.

Fan art is typically a non-issue because fan communities try to work thusly, "First, they agree to not profit from or sell copies of their creations. Though some of the communities run ads to cover hosting costs, most do not turn any profit and the individual authors never sell their works. Second, they always proclaim that their work is unofficial and has no connection with the creators. Finally, they respond to requests from the copyright holder to remove content and work with the creator as needed." ( [link] )

Don't get me wrong, I think you have lovely work. However, you don't make it clear that the characters do not belong to you (despite most people will likely guess that) and you are selling it. Copyright laws are established to protect Artists, that includes you and your own original work. If you want to create fan-art--have fun! But if you want to sell your work--create original work.

I have a feeling that if someone else were trying to put in 'all that effort' to copy some of your own original work, you might feel differently about copyright laws.

Do you know, I have thought long and hard about what i could reply but it just pointless to.

I am not well versed in this law and stuff to be honest, and I would be the last person to wilfully perform illegal acts. If i'm being honest, it has seriously put me off doing any fan art at all in future. I will contact Etsy and seek advice off them, not to pass the book but if things like this are a serious issue, Etsy has a duty of letting people know. After Woody, I'm doing no more fan art, (or art at all thinking about it - not for awhile anyway)
