I don't know, there seems to be instances where the Lich can't control individuals.ย The Ice King's crown seems likely that it would protect him.ย Also, consider the effects on his mind the crown has even when it's gone.ย The Lich might have been able to manipulate Simon, but can he control the Ice King?

Throwing this out there, princess bubblegums earrings protected finn and jake from the lichs influence, at least to a certain degree. Perhaps the same is true for ice kings crown, it protects him from that type of magic. Or alternatively, maybe the king is just so out of his mind the lich can't control him, I personally think the crown is more likely. It seems to deflect the lichs spells.

There was the fact that the Lich DIDN'T wipe out all life in the likely hundred of years until Billy was able to stop him (since Billy is half Giant according to the writers) so SOMEONE had to have stopped him. Perhaps Simon had to freeze him and that stalled him?

(Here's how I envision this going done.)
Lich: The end of all days are upon you.... Give in to the fate with dignity.
Simon: Marcy.... Run....
Marceline: B-but...
Simon: RUN!!!!
With tears in her eyes, Marceline gives Simon one last glance, before turning and running away.
Lich: Such defiance will earn you nothing, old man.... You are a weak fool, not even able to harness your own feeble powers. Without control, that crown is worthless. I'm the embodiment of Death itself!
Simon looks back, making sure that Marceline was gone. When he was sure, he took a deep breath and turned to the Lich.
Simon:..... I never wanted this..... This crown is a curse to any and all who come near it.... This thing has took everything from me. My sanity.... My love.... And my life. But now, with this war and you, it is clear what must be done....
The Lich looks at his suspiciously. He lifts his glowing claws up, prepared to strike.
Lich: Oh? And what's that?
Simon:..... I must give into the ice....
All of a sudden, a chilling cyclone of wind, snow and ice formed around them. The Lich looked around, puzzled, before looking back at Simon. But now, the man before him was glowing blue. His white beard was now three times as long. He was muttering something, and the Lich couldn't understand.
Lich: What is the meaning of this?
Simon looked up at him, his eyes pure white. And with a suddenly sharp-toothed, demented smile, he cackled.
Ice King: I AM THE KING OF ICE!!!!!!!! NOW, SUCCUMB TO THE ICE!!!!!!!!
