I don't think anyone would be able to make a visual novel out of this AND sell it. Gravity Falls is owned by Disney. They could make it, but they couldn't make any money from it.

Like I said above, a person would be able to sell it as it falls under parody law, reverse gravity falls is new content that makes comment and commentary on the original piece. The law is clear.

Pokemon takes down fan made games that are given out for free, so I kind of have a hard time believing that.

I'd understand if the names were changed as well and it was made to completely be its own thing while still commenting on the original, but they've still got the same names and are essentially the same characters with a make-over.

Yes in theory Cartoon Network could make a reverse Gravity Falls show for their network. Parody law is essential to what allows comedy to function in society legally, anything that is essentially making fun of something or making a mockery of it cannot be taken down by the offended party.Β
While most of my knowledge relates to Australian law the US has something very similar in its fair use doctrines. Ironically when it comes to Pokemon it is the serenity with which most people create such works that makes them unable to keep them up. Also a lot of people fear law suits, when it comes to most Pokemon instances they can't fall behind any doctrines of fair use, so they would be in a poor position to begin with.Β

I mean, people sell fakemon designs all the time and there seems to be no problem, but once a big, fan-made pokemon game is released for free they get shut down in a heartbeat.
I don't know, man. Selling fan-made games is something that never really occurred to me, so I haven't really had any experience with this other than what I've seen from Nintendo and Pokemon.

This falls under grey market law, technically he isn't selling his art, he is promoting your voluntary patronage of him. It is hard to prosecute anything that falls under patronage, your essentially paying a wage, and collecting what he does under it. What you do with it is what matters.
