This large space invader is cut out of plastic (perspex) and measures 2.1x1.5" (55x38mm).

well, in this case when it's based on something that was created more than 30 years ago, I'm not too worried about copyrights. Yes the shape is based on the invader, I did however sketch it myself by how I saw fitting to be laser cut.
Truth is it doesn't even look that similar to the shape in the original game.
And just like you can draw it and sell the painting, which is inspired by the actual game, I don't think this is different really.
