Description Ok I'm still a noob at this so get off my back if it isnt, but this has gotta be a prime example I mean she isnt claiming its hers but still I dont think this should be allowed to be posted this isnt a scanalation website. But yes correct me if I'm wrong and tell me how it isnt or what not I juss need some mentors or whatever

mmm well... it's not edited.. I mean, she haven't change a thing about the scene. And she does mention that she has taken the scene from Death Note's book. Maybe she just simply liked or found that part funny and wanted to share it with others?

well, yes, you are correct.
it is art theft. because she didnt create this piece of art herself, plus as stated in the manga itself:

the screenshot comes from page 80 from the first manga of the series.

plus, as stated in the beginning of the manga:

"death note (c) 2003 by tsugumi ohba, takeshi obata
all rights reserved. first published in japan in 2003 by shueisha Inc., tokyo"


"no portion of this book may be reproduced or transmitted in any form or by any means without written permission from the copyright holders"

It actually isn't considered art theft at this point since she doesn't claim it as her own. She's treating the site and this picture as photobucket. She simply need to take it down. If she doesn't, then one can report the deviation. This is a well known series of manga so it shouldn't be that hard.

Actually, anything that is submitted into DeviantART.com is automatically being copyrighted to the user submitting it. By submitting this, even though she may not intentionally or directly be claiming this piece to be hers (and, in this case, she bluntly acknowledges it doesn't belong to her), she is indirectly still doing so by allowing DeviantART to post the copyrights to it by the title of the image.

Every user clicks the "I accept" check box when they submit something, stating that they have read and agree to the Terms And Conditions and that they will abide by the submission guidelines of the website. As *SanzosKitten pointed out below, one of the rules is that "You must have done all the work or have permission to use the work." So this is actually considered art theft. Plus she's using the site as another Photobucket.

Actually the companies are cracking down on ALL scanalation sites so it wouldn't matter either way. DA's rules clearly state "You must have done all the work or have permission to USE the work." ANYTHING that is copyrighted is not available for use unless you get the owner's permission. For manga(and any comics) you would need the creator AND the book/magazine company that released it. For screenshots from anime(or any other visual medium) you would need the original creator and the company producing it.

It's the rules. It's copyright law. Doesn't matter how "little" or how "much" is stolen. If you submit something into DeviantART that you didn't make by your own hand, then you're "stealing" it.

If you aren't sure it's a theft, use TinEye on the image to see if you can find the original. I mean it's not in the group #Doombringers for nothing, you know :/

Not taking credit for a picture still doesn't give people the right to upload them to dA As I always say, just because you tell some-one you broke into their house and stole their HD TV doesn't make it legal. Hope that helps XD
