I do know Fairy Tail, but I don't exactly remember the scene it's taken from, so, yeah...
I don't think anyone can sue you for taking other people's pics as reference for practice (I believe everyone does that at least once), but if it resembles the original too much, the creator must be credited or even asked for permission. As far as I know, it's a copyrighted work.
