I think it depends on whether the character was created as an homage (or parody). If the creator/s acknowledge it, or if it's an obvious tribute, then I guess that's cool. And readers will easily know which is which, I suppose.

Thanks! Capt. Marvel was originally owned by another publisher, Fawcett. He was created because Superman was really popular back in the 1940s. Btw, Superior (top right corner) is also a kid like CM, but his strength level and the origin of the original character in the series are Superman-esque.

In a way, he is, but I wanted a group that had "homage" characters, similar in power class or origins. Captain America and Supes similarly have the "boy scout" personality and patriotism, but Cap is his own archetype; he's a "peak" human a la Batman, but he has his own category.

I see where you're coming from about the archetype except 2 things: 1) Cap isn't a darkish, pessimistic night watchman, and 2) he was blessed with superpowers from some experimental serum. Batman does not, for he was trained by some ninjas. Keep in mind that Cap was made in the 40s after Superman was made in the 30s so he kind of counts as a superman. He wasn't called a "Super Soldier" for nothing.
Just something to think about.

Cap isn't dark and brooding like Batman, yes, I meant that they're both the "ultimate" human heroes in comic books. The Super-Soldier Serum didn't give Steve superhuman powers; it boosted his weakened body to that of a near-perfect human male. Like Batman, he had to be trained to become an excellent combatant. Cap would suit a group with similar inclinations and physical similarities, such as DC's General Glory, Agent Liberty and maybe the Guardian.
Still, to each his own; I suppose we have our respective rules for categorizing. Thanks for commenting!
