I'm sure by this point Nintendo's realized they can't really get around Game Theory's popularity, so they've been embracing its implications instead of trying to fight them.

Though I find it more likely that stuff like that is something they hoped someone would piece together so they could embrace the moral grey area, rather than them being unaware of the implications of background details and letting someone who isn't associated with their company influence their decisions.
