So yeah, I thought things were better, then they changed the episode. In the wise words of James May. "Oh cock." I'm sure you know the story so I won't take up anymore space here.

EDIT: Things *seem* to be settling down slightly since I've posted this. Welovefine have gone back to using the name "Derpy" and the episode, untouched form when it aired, is sitting on the MLP website right now. Still no word on iTunes, but it's probably a safer bet that the episode is not there for another reason.

* Basically, some people complained about how Derpy was portrayed, and Hasbro and Welovefine are doing a back flip of sorts on the whole Derpy thing. Now I was going to leave it there, and assume that it was just the aforementioned 'some people' that complained that got Derpy pulled. But after a quick snoop around their DeviantArt and Tumbler pages, I'm not entirely sure. Yes they may of expressed concern over how Derpy was shown, but it does seem like a bit of an overreaction by Hasbro and Welovefine in relation to a few complaints.

'copyright issues over the name Derpy' is the reason that the 'some people' give for the Derpy disappearance. (Which, lets be honest, does seem very reasonable. Imagine how much money Hasbro would make if they made a Derpy toy.)
I've not linked to the 'some people's pages, as they kinda have a lot of angry messages and the such being shot at them, and I don't wont to add fuel to an already raging fire. There is no direct evidence that they were the catalyst that caused all this. They complained / made a note about Derpy; Hasbro and Welovefine reacted. Quite possible that it is just a coincidence.

Even if it's rare it might still happen, I know a lot of people like derpy but my point is is that someone was offended by it, disabled or not, maybe their family member was disabled and they found it offensive? Who knows, but you just have to respect hasbro for it's decision.

I'm not really an MLP fan, but derpy to me would still be derpy even with fixed eyes and a voice, she still acts like derpy, why does it matter if they fixed her up for a few people?

And I agree the shows I watched as a kid were a lot more awesome than the ones now, and it is a cause of a series of over reactions but that's just the type of society we live in and there isn't much to do about it ^^

Because those things are what made her different from the other ponies; it's what made her unique. I can completely understand that.

Not sure how old you are, but I grew up on the '80s show. When I was a kid, yeah, it was awesome! But I recently went back to try and re-watch them, and.....they didn't hold up well. lol

FiM is much, much better than the '80s series, because it's more than just a 20-minute commercial. Also, there's continuity of characters in the show, which the '80s series seriously lacked. That always bothered me even when I was little; when Megan returns for her second adventure in the world of the ponies, she doesn't even question where Melody, Firefly, Amber, and the rest are; they're just gone, and new ponies are in their place. x_x;;;;

As a long-time pony fan, I have to say, FiM does an EXCELLENT job with not just honoring the old characters, but putting a new and much-needed spin on it. ^__^

Aaaand....that's way too many words about ponies. lol

I'm a 90's kid x3 So I havn't watched as much compared to you. But I understand where your coming from, I just think it's unnecessary to have all this drama over derpy. To you know, respect hasbrp's decision on it? Obviously someone pushed them against changing her and they just had to.

That I agree with; I think this is the first and maybe last time a My Little Pony will be at the center of a hotbed of Internet controversy.

Yeah, it's sad they had to change it, and I don't agree with the likely reasons or decision, but in the larger scheme of things, it really isn't that big a deal.

Derpy Hooves is one of the many things in this show that makes it great. If Derpy was removed, or changed in anyway, the show wouldn't be as enjoyable as it already is. I didn't see anything wrong with the way Derpy talked or acted in the show. I just saw Derpy being Derpy, and I love that about her. Derpy is a big part of the shows fandom. If the show is about friendship, love and tolerance, then why are they changing a pony because she's a little different. That's kind of a mixed massage. You should love someone (or in this case, somepony) for who they are, not who you what them to be.
Bottom line: I love Derpy. And it would be very sad to see a great pony changed.

And now it's gone from bad to worse. Why did they have to change her? Why did they have to rip her away from us after so lovingly gifting us with the greatest thing we could ask for?

I felt like I was given a wonderful present that made me so happy, and so proud to be a member of this community. And then they took Derpy away, said she wasn't good enough. And then they have the gall to give her back, but not the same, no; because she just wasn't okay as she was. They had to "fix" her. But what they really did was steal her. People who actually care about us, they gave her to us. But it was people who couldn't care less that destroyed her.

could i get permission from you to feature this on my profile page? This makes me SOO mad! My friend introduced me to FiM a while ago and first thing in the episode I noticed was Derpy in the background. I LOVED her and she was the biggest reason I began watching the new Gen. Then he told me the cool story about how she became the fan based pony and they gave her the official name because of the fans and everything. So they think they can start something, then name it and please the fans..then take it back away? Derpy is the reason I loved the show so much and got so excited to see her on it. I want to support this and I LOVE your artwork on this issue.

This is a good motivational poster to remind people that it's okay to be who you are. Probably not proper for elementary school but I'm sure would fit in on a high school or college campus. Everypony needs to be reminded that just because a few don't like you doesn't mean you have to run and hide from who you are.

I know for one thing, it's the animators fault and it's the directors fault. The director wanted to fix the eyes, then had a second thought. It was funny to him that Derpy had to errored eyes. So blame the director.

I thought this thing was just someone being extra specially stupid, I didn't realise it had gotten this far. Derpy isn't an offensive name; derping is when you do something stupid, it's not a derogatory word for someone who is mentally handicapped. It's not a copyright issue. A character in absence of a larger work is an insufficient work to be copyrighted (there has been case law to support this). A specific art piece can be copyrighted, but someone else can draw that character and not run afoul of copyright infringement. The same is true of just a name; it's not enough of a body of work to merit copyright protection. Yes, Hasbro can use "Derpy", especially when they apply it to their own preexisting works, stories, animations, and products.

In fact, if there IS any copyright to be had, it belongs solely to Hasbro. US Code Title 17, chapter 1, section 106, paragraph B gives the original copyright holder exclusive rights to prepare and distribute derivative works. If there is any copyright to be had that doesn't already belong to Hasbro, applying a name to Hasbro's characters certainly is derivative of the original material, and therefore Hasbro has the right to call that character "Derpy".

Trademark is an entirely different matter. Trademarks belong absolutely to their owners, and the bar for whether something is "infringement" is much lower. You cannot use someone else's trademark without permission except under very limited circumstances, and never in trade. Though "parody" and "criticism" are among those circumstances (properly defined), the fact that Hasbro HAS used Derpy to refer to its own characters in trade establishes trademark even in the absence of registration (there are "registered" and "unregistered" trademarks). This too means that Hasbro has zero legal impediments to using "Derpy" as that character's name.

I am not a lawyer. However, I have had personal experience in enforcing copyrights and trademarks in the court system (for the record, I've never lost).

Plain and simple, what this is about are trolls, petty interfering busybodies, backstabbers, and professional martyrs. None of those are worthy of the slightest personal respect, and you all should remember who and what these people are all about in your future dealings with them.

I am very disappointed in Hasbro for caving in without learning the truth about what's going on. It's an act of cowardice. I'm not upset at We Love Fine or Apple, as their license requires them to do things like this if Hasbro tells them to. There's a staff lawyer at Hasbro who seriously needs to grow a pair of balls and say "It is self-evident that Derpy is not intended as a mockery of mentally handicapped people, nor should her depiction be intended as an attack, and will vigorously defend against and file counterclaim against any assertion otherwise. We shall continue to produce MLP:FIM to the same standards of excellence as we always have." And then, off-camera, say "We do not give in to butt-hurt bottomfeeders or politically-correct troublemakers."

Every time that Hasbro or others like them cave in, they embolden folks to be even more aggressive censors. The fact that people here on DeviantArt are leading that censorship effort is an act of betrayal to the principles of artistic and personal freedom; attempting to silence and constrain a whole studio is at least as evil as trying to silence and constrain an individual. Nobody can be a bookburner and an artist at the same time.
