you cannot copyright something that has a Gnu Public License. and considering Tux is under the GPL
your are infringing the GPL
now judging that you made a wallpaper for linux, i'm take it that your a "linux enthuasist" so you really like linux.
now i think its a cool background...but what really pisses me off is when people dont respect the idea behind open source. so > !
