Super Mario, Donkey Kong and Cranky Kong belong to Nintendo(also special mention to Rare)
So yeah, since Cranky Kong exists and yet is somehow the first Donkey Kong Mario faced, decided to switch it up to have Jumpman be his own character, Mario's dad, and rival to Cranky Kong. Thus, Mario and Donkey Kong III inherit their longstanding rivalry
