Ah ha! But you see! Sans can tell what run the kid is on. The human can be going pacifist sure... But sans might be able to tell if the kid is going pacifist. The town won't be evacuated. The kid won't have any EXP, the kid will smile and laugh once they meet sans, etc. While this does mean the human can just sneak attack and be a pacifist up until that point, the human wouldn't go through there journey just killing pap and then quitting. Reset to the rescue. Kinda. But you have a good point. In this picture however, the kid is feeling quite murdery.

Well, okay, a Genocide is pretty obvious, but Pap can die in any neutral run or a pacifist can be turned into a neutral. Yes, the picture can be interpreted some ways.
