1. Foreword
The order to follow is: Creative Commons < General Rules < Special rules on the deviation page < Written permission.
Which means that these rules override certain items of the Creative Commons license, and in turn, the rules stated in the deviation's description may override certain items of this document. Additionally, you may ask for special permissions in a note, but that will only apply to the item in question.

Lack of lingual skills (i.e. not speaking English) is not an excuse. You must fully understand the rules. If you do not understand something, have somebody else who is better at English translate it to you. Do NOT use Google Translate.


Terminology:

  • MMD: in this case, it also includes MMM.
  • Third-party application: any application that is not MMD, MMM, or one of their utilities.
  • Model: a complete character with body, face, hair, and optionally clothes.
  • Part: an item made specifically to be used as part of a model. Also includes accessories that are attached to the model in MMD.
  • Stage: a 3D scenery or backdrop.
  • Commercial purpose: use for sale, or revenue-generating purposes. This includes "charging [people] for the work, not the materials." No exceptions - if money changes hands, it's a commercial purpose.


2. You must:

  • Credit me when you use my work. See how to do it at the bottom of the document.
  • Ask me before you edit and redistribute my Models, humanoid and not humanoid alike.
  • NEW: ask for permission before using my work in MMD-Mall 's Model of the Month contest. This is so I can check whether using it would result in disqualification.

3. You may:
  • Use my work in MMD.
  • Use my work to create and share pictures and animations in MMD.
  • Edit my work.
  • Distribute your finished* model that has my work on it. Crediting is necessary.

* Finished: base + hair + complete outfit + accessories


5. You may NOT:

  • Use my work for commercial purposes.
  • Claim my work as yours.
  • Redistribute, sell or resell my original work.
  • Sell a Part or a Model that includes my work.
  • Use a part of my Models or Stages in your own, unless I give you permission.
  • Distribute a Part based on my work or a part of it, unless I give you permission.
  • Special restriction (in effect from the 15th of March, 2015): you may not use any of my works in pictures, videos, models and deviations featuring characters from or based on the following franchises (the list may change in the future):
    • None - all special restrictions have been removed.
6. Third-party applications
  • The rules above, plus the following:
  • You are allowed to convert my work to third-party formats (such as OBJ or 3DS) for private purposes.
  • You are allowed to create and share pictures or animations made in third-party applications using my work.
  • You are NOT allowed to share my work that you had converted to a third-party format.
    • This includes sharing through multiplayer games that allow you to load and display custom models to other players, such as (but not limited to) Second Life and VRChat.

The outside winter one...i think it was named winter world or something. It would've been perfect for the outside snapshots, considering it's supposed to be freezing cold anyway, one dies because of it. And the white of the snow adds to the definition of the girl and her blood, if i do it right. If you don't want me too, i can find something else, it hopefully won't pose too much of a problem.

That wouldn't be wise. It's best to create your own rules, or use a public license. Other than that, the rules aren't copyrighted; do as you wish.

Ok I'm not a fan of EITHER of these franchises either, but this is an incredibly dickish rule.
I'll follow all your other rules, and I don't make frozen or FNAF photos but I still don't think this should even BE here.

The rule exists due to the torrential quantity of low-quality spam. I want no part in that, thus the restriction. I also hate such rules, but it's a necessary evil until the spam is gone.

I am almost nervous to what may end up in the Special Restriction list in the future. I feel I should ask out of curiosity and future reference, does the restriction include, for example, not using an OC of mine that has clothing you made in anything that would include anything in the list?

Can I ask a quick question, I was thinking of making a stage MotM entry this month, and I was wondering if I could use parts from some of stages. Specifically:
Prospector Saloon
100 Rads Bar
Mountain Village

I know that your rules are pretty clear that that wouldn't be okay with models, but I wasn't sure if that applied to stages as well, so I thought it probably best to ask, just to be clear.

Thanks, I didn't notice I'd forgotten stages there. I modified it, now my permission overrides that rule.

Yeah, you can use parts from the mountain village and 100 Rads. Prospector Saloon, though... that one has some royalty free stuff that I'm not entirely sure I can share for editing. But I made that stage a long time ago, I think now I would be able to make everything by myself. Tell me which parts you'd like to use, and I'll make them.

As for this "stage MotM entry", do you mean next month's theme would be stages?

Thank you for granting permission n_n You don't really have to worry about making things specifically, I was just very aware that I do need 3 things that are listed in the mall, and I think that I'll probably have enough now thanks to you. Anything else I'll see if I can make myself (you know, when I'm feeling less lazy)

Actually it's for this month (I'm hoping to make a saloon bar) Although doing a stage theme would be awesome, I may have to seriously consider it for upcoming months, although I think that there may be a lack of basic part (like room bases, and simple stages) for people who pretty much only edit and don't actually do any modelling themselves

I have read this several times, so if this isn't a quick run over of what you are trying to say, then you may need to be more clear.

What you are asking is that we either send you a note/e-mail/skype message, to ask to use your products/models, in either a line of clothing for characters or to have your models in a picture, motion, or skit, while also giving you credit in the description when posting the deviation if we do by chance get the okay. But the question is, do we have to do this every time we wish to put your work/models up on dA? Or is it a permanent "yes"?

The majority has no trouble understanding them.

You must credit me each time you use my work. If it's a part of a model, then on a reference picture or the download. If it's a stage or accessory, then each time you use it on a picture.

This has many corners cut off and should not be seen as my official set of rules. I suggest you re-read the rules every now and then until you fully understand them.

Read, though not fully understanding. Are you basically saying no changing format, no giving away, no pulling apart and putting together on other models, no selling and no claiming as my own? So as long as I credit you I can still use some of your MMD stuff to make MMD videos/pictures/comics?

P.S. Please go easy on me. It's easier for me to understand short and simple rules. Having them set up as you do (no offense at all!) makes it hard for me to understand and it's just turning into mush in my brain T-T

Ok I have read your rules now, sorry.  Just a suggestion, throw Creative Commons overboard this will keep misunderstandings away.  Or If you still want to release your stuff under CC I highly recommend CC-By-NC-ND (no derivatives), cause CC-by-SA actually allows what you don't want ppl to do with your stuff.

It is the very first item in the list: my rules override whatever CC allows or forbids.
Besides that, it is stated that people are allowed to make and distribute derivatives (e.g. use my textures on a model; third section) while showing credits and using a compatible licence, therefore Share Alike perfectly fits my rules. Without section one, using No Derivatives would contradict my rules.
