1. Foreword
The order to follow is: Creative Commons < General Rules < Special rules on the deviation page < Written permission.
Which means that these rules override certain items of the Creative Commons license, and in turn, the rules stated in the deviation's description may override certain items of this document. Additionally, you may ask for special permissions in a note, but that will only apply to the item in question.

Lack of lingual skills (i.e. not speaking English) is not an excuse. You must fully understand the rules. If you do not understand something, have somebody else who is better at English translate it to you. Do NOT use Google Translate.


Terminology:

  • MMD: in this case, it also includes MMM.
  • Third-party application: any application that is not MMD, MMM, or one of their utilities.
  • Model: a complete character with body, face, hair, and optionally clothes.
  • Part: an item made specifically to be used as part of a model. Also includes accessories that are attached to the model in MMD.
  • Stage: a 3D scenery or backdrop.
  • Commercial purpose: use for sale, or revenue-generating purposes. This includes "charging [people] for the work, not the materials." No exceptions - if money changes hands, it's a commercial purpose.


2. You must:

  • Credit me when you use my work. See how to do it at the bottom of the document.
  • Ask me before you edit and redistribute my Models, humanoid and not humanoid alike.
  • NEW: ask for permission before using my work in MMD-Mall 's Model of the Month contest. This is so I can check whether using it would result in disqualification.

3. You may:
  • Use my work in MMD.
  • Use my work to create and share pictures and animations in MMD.
  • Edit my work.
  • Distribute your finished* model that has my work on it. Crediting is necessary.

* Finished: base + hair + complete outfit + accessories


5. You may NOT:

  • Use my work for commercial purposes.
  • Claim my work as yours.
  • Redistribute, sell or resell my original work.
  • Sell a Part or a Model that includes my work.
  • Use a part of my Models or Stages in your own, unless I give you permission.
  • Distribute a Part based on my work or a part of it, unless I give you permission.
  • Special restriction (in effect from the 15th of March, 2015): you may not use any of my works in pictures, videos, models and deviations featuring characters from or based on the following franchises (the list may change in the future):
    • None - all special restrictions have been removed.
6. Third-party applications
  • The rules above, plus the following:
  • You are allowed to convert my work to third-party formats (such as OBJ or 3DS) for private purposes.
  • You are allowed to create and share pictures or animations made in third-party applications using my work.
  • You are NOT allowed to share my work that you had converted to a third-party format.
    • This includes sharing through multiplayer games that allow you to load and display custom models to other players, such as (but not limited to) Second Life and VRChat.

Understand -- I'm neither challenging your rules nor arguing with them. (I'm a 3D modeller who was drawn to your skydomes, but you don't support my program, so I'm not going to download and use it in my program -- your rules carry, as far as I'm concerned.)

However... you can't actually open your content under a CC license and then restrict rights to that license. That's not how the permissions work. Otherwise, people would be amending CC and the GPL and the like all the time and people wouldn't know where they stood. The license has to trump conditions or it's not in force.

I think you'll legally get where you're trying to go more easily if you put the NC-ND license up instead, and then explicitly allow people additional privileges (meeting Share Alike in the conditions you support, for example). That way, you're maintaining the level of control over your IP that you want while extending the benefits of CC to the degree you're comfortable with.

As said -- I have no stake here, and I'm going to follow your rules as they're written regardless of the legalisms involved. I just don't want you to get crap from someone who decides to follow the CC-SA rules without regard to your conditions. You do much cool stuff and make it available for free to MMD users -- you don't need crap in your life for it.

If you render it in MMD and use that video as a cinematic, then it is allowed. If my model appears as a 3D object in the game rendered in real time, then it is not.

Ah ok, so just to clarify, I am going to use my own sprites/graphics/etc for the game, but I can use your models with credit for cutscene pictures? So, for a part of the story in game, because the game is 2D, so the picture would literally show, and then go away again. 

Of course, the models/etc would be posed and whatnot using MMD. ~

I see. I guess that's the problem with generosity, it's hard to find a way to be generous and not taken advantage of at the same time. I assume you put your rules in the info box so it shows up when it's loaded into the program. If they are given a reminder there, it might be helpful.

I just let people have at my stuff. I think it's good for the community. I have been putting my work under Creative Commons with no rules for as long as i've been on DeviantARt, and I did the same on my old account. If I work really hard on something i'll ask for credit, but that's it.

For the game content part, if an image appears for a moment in the game with a model using one of your parts, but it's not a main part of the game, is that permitted?

If you render a picture in MMD with my work on it, then use it as a texture or sprite, then it is allowed.

However, it is not allowed to use my work directly as a model or part of a model in the game (if the original model data is present in the game).

Quick question. You say we can edit but not put parts from yours onto ours. Does this apply to rooms? I'm making a recording studio room out of various parts from different room stages and I'm hoping I can use the desk from your bedroom stage. Is that allowed? Or would that count as taking parts?

Oh, and the only sharing I do is on my facebook, so if I post anything on my facebook with anything made by you in it, I'll be shure to link people to the deviation. Although, no one I know in rl has MMD. Okay, I readed the whole thing calmy. There is one thing I wonder trough. I don't say you have no right to say it, I don't try to argue, I just wonder.


Why are we not alouwed to make a render in 3Ds Max (or simulair programs) if we do not edit a thing on your content? I get it are programs used for modeling not for rendering, but Max can make some truely amazing renders, and if we do not edit a single part of the content by you it would just be a render, just like you make in MMD, Vidro ect. Diffrence is, 3Ds Max (and simulair programs), can make full HD quality pictures with amazing shadings, wich are not posible in MMD or MMD related programs. Mental Ray is a example of this, or just think posibilities like when you (for example) use that drak mage chain you made on a model, and want to render it in Max for the awesome realistic hair of the Hair and Fur option (example of hair and fur: www.templates.com/blog/wp-cont... , you won't get hair like that in any MMD realted program, neither such a render...)


Again it are your rules, and I will respect them and setranly not break them. I just wonder why we may not use these programs if its only used for a render, and no editing on parts or models created by you.

I just don't like it when people make Vidro renders and call them MMD. I might delete that rule though because I want to try Vidro or Keyshot aswell.
