if it's a TRIBUTE to the artist... that's what a lot of people I see don't understand... the difference between THEFT and TRIBUTE. They're like frickin s or something... and they also seem to think it's okay to bash new people... which unfortunately is one of the biggest things that people hate about DA users... or the anime community in general...

You know that there's a difference between tribute and theft right? A thin difference,yes but a difference. A tribute is when you make something dedicating it to someone like if an artist decided to draw the OC of someone they know or fanart,they give credit to the owner and says it not theirs; Theft is when you purposely take something whether it be an OC,design,or art and claiming it as your own not including any source or credit. The difference is with a tribute you doing something in your own style and giving credit not taking it as your own. Also if people don't want their art for free use So What Its their art and they have the right to say if they want it for free use or not,Not yours =A=

There is no difference between Theft and Tribute if someone uses copyrighted material in their artwork.
Copyright law exists for a reason.

Designs aren't, and shouldn't be copyrighted. You are aware of the fact that somewhere on this site, there's a user who has the same fursona design as you and didn't give your little page even one look, right? Or does Encyclopedia Dramatica not teach that? Umm, ok, let me just ask you something.
WHY shouldn't designs be copyrighted? I understand that some OC designs can appear similar and that's not a huge deal (especially if the OC is a common animal such as a dog, cat, etc...), but OC's all have original designs or original elements in them...making them one of a kind.
Now I personally have copyrights on the design of my OC's...If someone were to copy the design, I would be greatly concerned considering my OC is not a "common animal"...It is unique and one of a kind. I'm willing to protect my designs...if someone uses my designs without MY written permission, it's THEFT...end of story.

I understand fan art, but it looks like you trying to say you can get inspiration from another design. This is mildly true...you cam, CAN get SOME inspiration from a design, but don't, whatever you do, copy the design or large elements of the design in full! You can get inspiration for colors, markings, weapons, etc...but that's where it stops! To come out and rip off a design, a COPYRIGHTED design, IS theft....and I can't stress that enough.
And no, I'm not talking bullshit. I'm studying in the field of mechanical engineering and metrology...and let me lay something on you...Patents
Am I going way off subject? Hell no! Patents are copyrights on real world items. If you were to copy a design that was patented (AKA copyrighted) by someone else, you're going to get sued and possibly get your ass thrown in jail!
No, stealing a design of an OC isn't going to result in layers, but just think about how wrong it is when put into the above perspective. I'm sorry for writing a bloody wall of text, but this is how I and MANY other people feel about this subject.
I'm not a bloody, "Head crab" neither...just a concerned (not to mention deeply confused)person. Honestly, this whole argument you started is completely worthless. Patenting a character is probably the biggest waste of money I can think of. However, if you somehow made your little comics into a major series and got as big as say, The Amazing World of Gumball, THEN I'd say it was worthwhile. But in a lot of cases here, you're just throwing money out the window.

Well I am considering publishing my works....and who said I'm patenting my design? I just have copyrights on it. DA has helped me with several people who have taken my ideas and the offending works have been removed. DA helps with stolen ideas and artwork....if you think copyrights are a bad thing that shouldn't exist then you are clearly on your own here.

First off I would like to say I'm not trying to be rude and I'm not on anyone's side. I just stubbled upon this. There is a diffence in using something for inspiration and down right copying. Just about everything is inspired by something else, but that's not the same as copying every little detail. People should use their own creativity. You know? And actually, yes character designs are copyrighted. That means no one can use the EXACT same details. Not that they can't use a certain aspect of it. And if someone does steal a character design, not only can they be banned from dA, they can also be sued. I'm not griping at you, I'm just informing you.

Digital art is real art just as tridional art is, hun. And people need digital art now a day since everything is going digital. And that pictures not really anime.
