To commemorate the start of a larger scale adoptable project we have my very own first OC GF PLZ NO STEAL, Chromia. Before you shout about the listed price, this one is kind of a joke. This is planned as the start of a project to be some combination of traditional adoptable style content as well as fundraising for various charitable causes and this one is absurd so I can link back to it.

I am using the space on this first one to put some of the more specific fine print terms here below so I don’t fill up the description of each new one. The charity specifically focused ones I plan on having clearly identified, but if you ever have any questions, let me know.

ENLIGHTENED SPACEMAN’S ADOPTABLE ART TERMS OF SERVICE AND USAGE LICENSE

    Introduction

    1.1 These Terms of Service (“Terms”) govern the use and licensing of all artwork ("Adoptable Art") listed for adoption by the artist (“Creator”) on DeviantArt (“Platform”). By adopting Adoptable Art, you ("Adopter" or "User") agree to abide by these Terms. If you do not agree, you are not authorized to use or adopt the Adoptable Art.

    License

    2.1 Upon adoption, the Adopter and the Creator are granted an exclusive, non-transferable, non-sublicensable, worldwide license to use the Adoptable Art. The Adopter is permitted to distribute but not re-license the Adoptable Art.

    2.2 The Adopter is permitted to use the Adoptable Art for both personal and commercial purposes, provided the Creator is credited as outlined in these Terms.

    Modifications

    3.1 The Adopter is permitted to alter, modify, or create derivative works from the Adoptable Art for use in personal or commercial projects, provided the Creator is properly credited for the original image.

     Copyright and Intellectual Property

    4.1 The copyright and any associated intellectual property rights of the Adoptable Art remain with the Creator. Adoption of the Adoptable Art does not transfer or assign any copyright or intellectual property rights to the Adopter.

    Attribution

    5.1 The Adopter shall always give appropriate credit to the Creator when displaying the Adoptable Art or its derivative works in any public domain or on any digital platform. This includes mentioning the Creator's name and linking back to the original Adoptable Art listing on the Platform.

    Termination

    6.1 The Creator reserves the right to terminate this license at any time if the Adopter fails to comply with any of the terms.

    Warranties

    7.1 The Creator warrants that they are the original creator of the Adoptable Art and have the authority to grant the license.

    7.2 THE ADOPTABLE ART IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.

    Liabilities

    8.1 In no event shall the Creator be liable for any claims, damages or other liabilities arising from, out of, or in connection with the Adoptable Art, the use or other dealings in the Adoptable Art.

    Acknowledgment of Generative Technology

    9.1 The Adopter acknowledges that the Adoptable Art is a product of generative or synthographic technology. By adopting the Adoptable Art, the Adopter assumes any and all relevant risks and liabilities associated with the presentation, distribution, use or modification of the Adoptable Art or any derivative works thereof.

    General

    10.1 The failure of the Creator to enforce any right or provision of these Terms will not be considered a waiver of those rights.

    10.2 If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

    10.3 These Terms constitute the entire agreement between us regarding our service, and supersede and replace any prior agreements we might have had between us regarding the service.

    Governing Law

    11.1 These Terms are governed in accordance with the laws of the country/state of the Creator's location, without regard to its conflict of law provisions.

    By adopting the Adoptable Art, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you have any questions about these Terms, please contact the Creator.
