She isn't Penders' character. In fact, someone asked him about her on Twitter, and he said he never considered her his, and never even tried to claim her. She still belongs to Archie, or, by Penders' logic, to Gallagher, who created her name and likeness with Auto-Fiona

Now the question is whether she'll appear in a comic again if that's the case.

That's up in the air.
The bad news: Archie have erased every non-SEGA, non-SatAM, non-Flynn character for the time being, until they can ascertain who owns what.
The good news: Archie are hunting down old writers and trying to regain their permission.
The other bad news: Penders is trying to get his hands on some of Gallagher's cast, because Gallagher created Athair.
The other good news: Gallagher has written stories for Archie since 160, and would probably lean towards their side, plus associating with Penders is a death sentence for one's career after the stunts he has pulled.
The other other good news: If Penders wanted Fiona, he'd have claimed her in the first place.

Mike Gallagher, if that's who you're talking about, had been with the comic since the beginning. It was a Gallagher/Dave Manak production back then, in the more jokey style of "Adventures of Sonic the Hedgehog."

Rummor isΒ that Penders is also trying to track down the artist to get them to give control of ther characters to him.Β He has many of the old artist already backing him. And has a few of them helping him work on his new book.

This would make a good scenario for a story in which the Suppression Squad is completely wiped out and Fiona is the only survivor. I already did a short story that hass her regretting her past actions andstarting a new life. Now it's a matter of incorporating that idea in a future story.

I don't think Flynn could write her as someone independent of Scourge, and either way, the Squad are off limits for vague reasons.
