The GIF & PNG file formats let you make one of the colours transparent but I don't think Paint will let you use this feature (I think some older versions of Paint could do it, but not since Windows XP.
~Spaarghy wrote a tutorial [link] about how to make an emote in Paint. At the end of this tutorial she has an emote that seems to have a transparent background but when I tried it I couldn't get it to work. You could write her a note to ask how she did it.
If you can't get it to work in Paint then you'll need another program. I use Paint Show Pro for my static images and GIF Animator for the animated ones. You can download trial versions of most editing programs but they might be time limited. Quite a few people use a free program called The Gimp that you can get from [link]
