I'm pretty sure you seen this mean machine, it is the Guardroid, origionally built to guard Dr. Doom's castle in Latberia until it was stolen by the Kingpin, who reconstructed it and reprogrammed it to hunt the Punisher [link] , it appears in the second stage of the arcade game where it kills Bruno and his goons before you could fight them where this mechanical monster is then fought as the level's boss, later in the game, you fight a second version of the Guardroid that has red armor.

Whenever you think Capcom or Marvel Comics owns this character is up to you and if Capcom owns the rights to the character, should Marvel get the rights to to the Guardroid so it would appear in the comics?
