I'm pretty sure that Digimon is really copyrighted to Bandai, Toei has them because they were doing the dubbing for Digimon Savers.

Actually Bandai owns the rights for the games of Digimon, if you see the box art of the Digimon Battle Spirit games for Wonderswan color you can see the logo of Toei on the box art as well.
Toei were the ones who did all the seasons of Digimon and not only savers, you can see this even on the movies because they at first show the logo of Toei before the movie starts, same with the series in japan.
The main owner of Digimon is Akiyoshi Hongo and he gave Bandai and Toei the rights to comercialize Digimon as games and as anime ^^
