As I understand it, that rumor, while popular, is inaccurate as anything created while employed under a company is property of said company. I've yet to find instances of something like that happening within other companies, and there's certainly no evidence suggesting that's the case for Mighty.
That said, it's a more comforting explanation than the simple fact that Sega seems to not wanna use him

yeah but when the media says the samething a lot over and over, its kinda hard to think of what you said could be true, not saying your wrong or anything. But that also goes for Ray, i don't know why the other characters aren't in the games like bean, bark, or fang.

It's not good practice to believe things simply because they've been repeated--that type of approach makes things like chain mail and old wives tales and internet rumors so rampant
All the old phased out characters probably aren't appearing anymore for the same reason, and I doubt that reason is because every single person that designed them owned the rights and left.
