Description Ladies, Gentlemen, everything in between. We are in trouble. Usually I hate getting political, but this time I feel I must break that rule.

For those who don't know, the EU has passed a little piece of legislation known as Article 13. This spells disaster for the internet as we know it. Article 13 changes the game by placing the responsibility of copyright infringement not on the up-loader, but on the platform that hosts it. A small change but with big consequences.

This unfortunately follows that platforms like Youtube, DeviantART, Fanfiction.Net, even Facebook will be under threat of a lawsuit. The Article is so heavy handed that platforms might implement a zero tolerance policy, meaning anything that risks breaking Article 13, including stuff falling under 'fair use' will be automatically targeted and removed. Platforms like Fanfiction.net can't possibly exist, and fan works on deviantART will have to removed. Youtube videos, including harmless blogs, might be disallowed for fear of a whiff of copyrighted material in the background, including music, sounds and posters.

Which unfortunately means my own shows like Mario and Luigi: The Mask and Mario and Sonic Adventures must come to an abrupt halt. Your favourite artists could be wiped out over night.

Those outside the EU will also eventually feel the burn, because if this is allowed to go through other countries might decide this is a good idea.

But it's not yet over. The Article is due to be ratified in January. Those within the EU, including the UK, please contact your local European MP and tell them how much of a bad idea this is. It is possible this Article was drawn up without understanding the full implications of what it means, since most Government officials never grew up with the internet nor understand what a creative melting pot it truly is.

I also strongly recommend you also look into Article 11. This could also spell disaster for alternative media on the internet, and could in effect lead to another Article 13 like piece of legislation moving in the background, and we'd never get to see it until its too late.

So contact your member or Europoean Parliament Member and let them know you're concerns with the way this is heading.

And I thought it only applied to Youtube... how will you do then to publish your series ? You can’t just send them to us, even with a link in Google Drive or other platforms. It sucks.

This is the only time I wished I could vote. If the law is to be voted just after my birthday, I hope I can vote against.
Living without the Internet, living without music, living without a computer or a phone, it’s okay. Losing all those creations, free ones, that’s another thing.

Fortunately I don’t think it’ll work out. Eventually some extremely powerful platform might get an exception. Maybe at first, since there won’t be concurrence, it’ll abuse its power and make us pay. But I think it’ll have to soften over time.

Or else we’ll see how much we were wrong about our, how to say it, « democracy »? « Freedom »? And see how much more our lives are easily influenced. Okay that’s a little complotist, but come on.

I wonder if another country, that doesn’t belong to the UE, will propose its services.

But maybe I’m thinking too much and uselessly. I’ll go see if I can vote. And download even more musics and games before it’s too late. I’m glad my computer has enough memory. And I hope this won’t pass. But it’s only hope, and I don’t trust that.

That's why we all need to contact our EMP and let them know what the heck they've could be about to ratify.

Article 13 is pass, HOWEVER, it still needs to be ratified to pass into law. That comes into effect this January, so there is still time to fight it.

Contact your local European Member of Parliament and help explain why Article 13 as its currently written is a terrible idea.

Explain how it'll stifle the freedom and creativity of the internet and who it'd be doing everyone a disservice to allow this to be passed.

if Article 13 comes through,there's two things we can do:

First,vote the MEP Axel Voss (creator of Article 13) out of the European Parliament during the European Elections in 2019.

Second,migrate our stuff to an unknown and small new platform that the lawmakers don't know about.

I don't think that'll do much good once it's in effect. Many EMP's are all for this, I'm hoping because they don't really know what they've voted on. They only know the surface argument and benefits to copyright holders, not the damage it could do to the entire internet, because to them it's just a communication hub and nothing else.

Worst case is the EMP's were motivated to vote for a very George Orwellian 1984 reason. Meaning they did know what they voted on and voted on it anyway because it'll control information and how its spread. Ever heard of the ridicules claims that certain 'democratic votes' in recent history were affected because of meme and internet culture? Some in higher positions really take that statement seriously. That could be an alternative motive for Articles 13 and 11. To stop the spread of ideas that could convince people to vote a particular way.

As for migrating to other platforms

Thing is, its not the law makers targeting the content. It'll have to be the platform itself having to dissect and remove its own content, self censoring. These platforms are businesses after all and need to survive. Any new platform will have to take these new rules into consideration or risk being sued into oblivion before it even has the opportunity to become mainstream or profitable for its own existence.

From what I've read, its copyrighted characters, therefore is potential copyright infringement, therefore not worth the risk having it.

OC's might be let through with a pass, but I doubt it. It would be funny if someone makes an image of Felix the Cat, and Sega claims copyright because it looks like a Sonic Character.

No, I fear the original creators pretty much won't get a say in it, even if they were okay with it.

It's the fear of a lawsuit that will make these platforms block everything, just in case the original creators want to sue, and have actual grounds to sue.

Sometimes a lawsuit doesn't have to be legit or be won, it'll still cost both sides a great deal of money, and if enough companies and original creators decide to ban together and come down on the platform they can sink it without actually winning a lawsuit. Therefore destroying the offending platform, and since most platforms are businesses they can't allow that to be even a remote possibility.

Therefore, better to be safe than sorry and ban all of it.

I'm afraid that'll have to go. Along with Super Mario Bros Z, Super Smash Bros Adventures, my own works of Mario and Luigi: The Mask, Mario and Sonic Adventures, my own fan fictions, fan works, fan art. All of it would become grounds for a lawsuit.

Because under Article 13 you are no long responsible for the content you upload. The platform provider is. And its more 'acceptable' to sue a legit business into the ground than sue millions of average-joe content creators  

That's why this needs to be fought and needs to be kicked out.

From what I understand, your videos will be allowed to stay up, but they will be blocked within all EU states. Following that, anything you do upload will be subject to Article 13. Break it and your entire channel could be removed.

Personally what I might do is move all videos to private to see if I can save them from deletion, but I doubt I could load anything new privately because the aim of article 13 is to come down on copyrighted material, and it could still be considered a form of sharing/pirating if you dare to share it with another internet user.

That's about the size of it. You won't technically have done anything wrong, but Youtube can't take the risk of a copyright holder either finding it or being informed of its existence on their platform.

All platforms, its not just confined to Youtube. Dailymotion, DeviantART, Fan-fiction.net, Facebook, Reddit, Tumblr, Twitter. Anything that can host content whether as pictures, video, audio. It'll have to self censor, or either shut themselves down or be eliminated by lawsuit.
