I'm sure nobody recalls the sketch I did ages ago; [link]Well, I had nearly forgotten too. However, it was brought to my attention when shared with me that Mr. Patch is, in fact, going to be in BK3. Excited as I was; I went ahead and colored this long-forgotten sketch to what you see above.
I must say, I'm quite excited for BK3, which might just be multi-platform; [link] --which is good because all I have is a Wii...so I can hope and dream, yes?

Hate to shatter your dreaming, but the Mario is just a custom vehicle.

I got that off the Rare game sight. Why would they advertise a character they don't own? I can imagine a gamer doing this, but they're advertising their game with a character they wouldn't normally have rights to.
It'd be like Nintendo using that Cloud-guy in an ad for a game, but the game not being released on...eh, the Playstation, I think. :l

It's just Rare being the joking British folks they are as they blow Mario's head off in the trailer. And they're not really committing a copyright crime. It's just a method of customization building like you can do with patterns in Animal Crossing. It was also confirmed in an interview.

Well that's completely different.
Rare is not owned by Nintendo anymore, Microsoft owns them. Whether or not Banjo-Kazooie: Nuts & Bolts will be on any other consoles is up to Microsoft.
