No I did not. He was passed out drunk! In all seriousness I believe that in a public place we are susceptible to be photographed and have our image posted on the internet. It's not photojournalism because there is no newsworthy even, but in this genre of photography I feel that I am documenting everyday life as it happens. Also, I think his anonymity is fairly well preserved. If you ran into him tomorrow at work, I doubt you'd recognize him as the man from this photo.
One last thing, I actually had this exact same thing happen to me in Tokyo. I passed out drunk in a flower pot in Roppongi and my friends who were with said salaryman were taking my picture with their phones. I am totally okay with this and it is simply a consequence of our modern society.
So in short, I don't feel I need permission.

If that's the case, then he should post that it's not actually a drunkard... But if you read his comments, he's certainly saying it's somebody he photographed at random...
So consent should be necessary at all times...

I saw.
But hey.. Isn't it a human right to say "I don't want to be taken a picture off, and less published," and I am sure there is a law that says that you can take a picture of a crowd and submit it everywhere, but you can actually get sued from posting a picture of one single person without permission.

It IS a human right to say that. And, if you post a picture of somebody without the consent on Facebook/Twitter, you can be reported. =\ I don't think that one person understands the law very well...

Not really anymore. Candids, I'm pretty sure, are basically completely random pictures. I'm pretty sure the street photography section is filled with people who don't know they've had their picture taken.
Plus it is easier to take pictures of people without them knowing it, with all of the nonflash options, and the ability to keep things hid.
But this is probably a candid of a drunk man, in Shibuya. He is pretty much asking for pictures to be taken of him.

It's not very candid if he has a picture out in the open. And besides, what if that man doesn't WANT his picture to be taken? Or posted on a website for people to view? He still holds his rights.

Considering the fact that everyday a person who holds actual rights has their picture posted on Facebook or Twitter without their say, I think your argument holds no water. Especially even more so when these people are sober.
Plus it is in Shibuya. I don't know the rules of taking pictures of drunk sleeping people in Japan, and I am sure you don't either.

I dunno about the laws of non-profit street photography, but "the victim was drunk" should never be a free pass excuse. XD
If, for example, he were to be robbed while he was lying there, yes, it was bad judgement on his part to give a thief an easy opportunity, but that wouldn't make the thief not guilty of a crime.
I believe the basic rules of street photography though is, as long as you're not making a money profit from the photos, you don't need to get permission to take them or post them online.
