Description I appreciate all the comments with concern about Nintendo suing me into oblivion. I don't think thats going to happen. if Nintendo contacts me and asks me to stop (which they might) I of course will. Thats fine. Until then I'm going to keep telling the story I want to tell.

I figure you don't have much to worry about with novels like Ready Player One or Jim Hines's Magic Ex Libris series out there, not to mention the vast, vast well of fanfiction on the internet.

I'm still not sure she knows what "Super Effective" means. Electric attacks do only normal damage against fairy types. It could be a critical.

Oh, no. It was by another company. And it wasn't even a lawsuit. It was just some legal bullying, but unfortunately it drove my small game company out of business when I tried to fight it. But this is a pretty different situation.

Honestly I think it’s different enough to qualify under fair use as being ‘inspired by’ rather than copying.

It was a luck bunny summoned by magic, not a pokemon caught in a pokeball. It’s appearance is based on her interests, and you even showed how her sister’s luck bunny looked different.  It may look and fight similar to a Pikachu, with some minor style differences, but the storyline made it clear it is definitely not a genuine Pokemon, but a creature of magic who’s appearance and abilities were influenced by her love of pokemon.

Which, I actually know a fair bit about the topic because I’ve fought to take down art stealing websites in the past, so I’ve done research into copyright laws, Fair Use, take downs notices, and all that jazz.

Where they would be able to get him is the fact that Modest is using the actual Ability names for Pikachu. If they really wanted to get him on something they would be able to get him on this. It's not right but they could. One way to avoid it would also be to give this one a Brown tipped tail. Which would be more different from the original but still very recognizable

Well the ability names are little more than random words, not really anything distinctively named like the various specific terms like ‘pokeball’ and what not. I doubt this would be significant enough to get on Nintendo’s radar. Usually companies focus on things that are more directly copying their work, like if it was captured in a ball then battled a different pokemon.

Well yea. That's why I said that if they really want to get him they could use this. As I don't know if this would be transformative enough to not be.

I think you're probably right (but I'm no expert at all) but I also know that, if Nintendo wants to, they could sue me into oblivion for pretty much anything, and theres not much I can do. But i doubt they'd want to. Its not worth their time at all. What they may do is send a cease and desist order. Thats happened to me before (for a non-Modest Medusa releated project years ago). If they do I'll go ahead and comply. No big deal.
