So there has been alot of fuss over this photo looking very similar to the cover of the Twilight book. I'd like to take this time out to state that the similarities between the two happen to be completely unintentional & very unfortunate. I did not realize how alike the two were til after I posted it on another site some months ago. So now that you know that I am aware of how similar the two look you can all stop bringing it up please.
The inspiration did not come from Twilight at all, in fact I am not even remotely close to being a fan of stalkerish sparkly vegetarian vampires. I got the idea to do this last year after a friend sent me a link to Gnarls Barkley's video for "Who's Gonna Save My Soul". I had intended to originally do several photographs using hearts but this was the only one I ever got around to doing.
By the way, for all those wondering: Its a pig's heart.

Why would she be sued over it? It may not be too much of an original idea, and it may have been done by other people, as well, unintentionally, but it's still her own work, her own photograph, and her own rights.

FAQ #8: What does deviantART consider to be Art Theft? the photographer for the twilight merchandise actually had an issue with deviantART over very realistic replications of the posters. Not tracing or anything, but so close to the original that it was against the law and the work had to be removed. A compromised was reached and the artist was permitted to show this deviation: [link]
so while what ~Somedumbrobot suggests may be unlikely, that doesn't make it untrue. Twilight has already demonstrated that they will have art removed if it's too close to the original. And while this has a pigs heart, consider that the image in my example was a graphite DRAWING. Totally different medium from a photo.

Art is art as long as someone worked to accomplish it and it's rightfully theirs. The ONLY reasons why this matters is because enough idiots read and fell for that ridiculous shiny vampire BS to where it is or is close to being world renowned.
If Twilight was not such an attention whore, this would NOT be an issue and I think it's damn sad that it is.

im just saying you need to stop being so fucking stupid about this stuff and acknowledge that though you disagree with someone, it doesn't mean they are wrong. Interpretation doesn't matter when it comes to the law and policy. This image isn't just hands cupping something, it's so similar to the twilight cover that if they wanted to do something about it, they'd be 100% in their legal rights to do so. Stop being such an ignorant swearing crybaby. This happens in all forms of art. Ever listen to Tom Petty or The Red Hot Chillie Peppers? Consider there are only so many guitar chords in the world so songs are bound to overlap to a degree, but though "Dani California" and "last Dance with MaryJane" are seemingly different songs they have nearly the exact same chord structure and sound incredibly alike. Alike enough to have started a legal feud. So the same argument could be made "so if I play an Am, Em, and a G I'm infringing on every musician who plays those chords?" probably not, but if the songs are so close together as these two images are, then yeah, you might be in for trouble.
I'm not calling this artist out on anything saying they're an art theft, I'm just pointing out that the person who made the copywrite comment had a valid point. And if they're already running into trouble with people confusing this with twilight, it would be important for them to know and understand the policies and legal issues that may surround it.
You think it's not a big deal, but given past issues it clearly is for parties involved.

She didn't "steel" the idea, you little fanboy. Every idea has been thought already in one or another way and "giving someone your heart" isn't exactly original in the first place. I wrote a screenplay about that 5 years ago and drew a similar picture myself.
So, before you pull out the big guns and call someone a "thief", think a little. Just because someone touched the tiny little bubble of popculture-knowledge you live in, doesn't mean you can put down productive and creative people who try to express themselves.

And also, she said she did not intentionally get the idea from Twilight. Twilight's cover is ALSO a very unoriginal idea, therefore it was pure coincedence.

Dude, the idea has probably been used by a million other people. It's highly unoriginal. It's like drawing a smiley face. You can claim the ART for yourself because YOU, yourself, did it, though, a million other people have drawn smiley faces and claimed their art for themselves as well.
Another example is what I just submitted. A picture of my pet Iguana. I'm sure other people have taken photos of wild iguanas or their own pet iguanas and claimed their photograph for themselves, just like I did with mine.
She either took the photo herself, or had a model pose with the heart and took the picture, which is still her own work because she composed it and gathered the correct model for the job.

The whole giving a heart idea is a typical macabre/horror pose, it's just in this case it was held out infront of the woman.
I personally hate Twilight. It's unoriginal all around and a plain old WTF scene, to me. I hate any and all of the Twilight series and want no part of it, but when fans get butthurt over a piece of art that's coincedentally similar to the cover of a shitty vampire book that has majority of the idiotic society in it's unmerciful grasp, I won't stand for it.
