How do I get to use your wallpapers with your permission?

👍: 0 ⏩: 1

OtisBee In reply to blacknyax [2015-05-27 14:22:56 +0000 UTC]

it all depends on what you want to use my wallpapers for.

of course, if you want them for personal use on your desktop, then you don't need my permission to do so.

but if your intent is to use my graphics (which includes my wallpapers) for any commercial or redistributional purposes, then asking for my permission is what i ask for. this might seem obvious and rather self-explanatory, but many people seem to believe that everything that's found on the internet is free to use and that they can do whatever they want with it. that's a common misconception.

by default everything someone creates is under copyright protection and there's no need to explicitly mention this. but then again only few seem to really know about this and that's why i created the above badge for my and everybody's use, so they can clearly make visible that asking for permission is not only polite, but also mandatory.

again: nobody cares what wallpapers you download and use for your own personal and private pleasure. no permission required. but as soon as you'd intend to redistribute or even make money from it, then you do need the permission of the copyright owner.

and getting a permission is basically just a matter of asking for it. then you will most likely be asked what you want to use the graphics in question for and then, when you provided enough information, a decision will follow on whether or not you get that permission.

i hope that answers your question.

well, in case you're using it, then at least nobody can say that they didn't know anymore.
it worked for me thus far, although i don't know what'd have happened without that badge. haha, i guess afterall it's just some sort of a placebo that's capable of putting your mind at ease.

anyhow.. i'm glad you like it. may the badge serve you well.

Rippers... a real nightmare for us cell phone themers... this badge is maybe too polite for them! What about a new version, like this one : "Don't use my graphics without permission, or I'll kick you a*s"?

👍: 0 ⏩: 1

OtisBee In reply to ShaolinAssassin [2011-09-14 20:39:44 +0000 UTC]

hahaha.. nice idea.

but i think that this would only challenge any potential ripper to try and test if he really gets his ass kicked, which wouldn't be what you want in the first place.

you know, i believe that many people still don't know that you can't just use anything you find on the internet. so, basically i created this button/badge so that nobody can ever say that he didn't know that i don't want my graphics to be used in another work. those who violate on somebody's copyright deliberately, will do it regardless of whether there's a button or not and no matter what's actually written on it, imo.

honestly, i'm convinced that threatening and insulting the ripper doesn't provide much impact and doesn't solve a thing. and let's face it: what is it that we can actually do against getting our work ripped? can we really kick somebody's ass? i highly doubt that and so does the ripper. so, we shouldn't promise things we can't keep.

if at all, then i think it's best to keep a calm voice and to show courtesy even to the stranger who's know making efforts to steal from me. often it's only some education that's required to make somebody stop stealing. and if you treat someone with respect, then it's likely that you'll get back some respect in return. not always, but the chances are much higher, as when we would opt for the insults and threats. this would only make people become defensive and makes the situation more difficult than it already is.

well, at least that's how i think about it.

Otis, I totally understand all you argues, and mostly agree with all of them, but facing to reality, I don't think the same as you do. I don't know if desktop customisers been ripped and redistributed everywhere on the net, but it's a real common thing for cell phones themes. How many times I found my own themes on some Russian or easter Europ site? Too many times, unfortunately. It really pissed me off. I spend a lot of time fighting and reporting on sites such as zedge to delete my themes they posted without permission. I have even been ripped on deviantart , it was something I really did not expect here. See here if you're curious : [link] But well, we have to deal with it (that's why now, most of themers use flash intro with signatures), or stop to share. I'm just having fun theming, dont take it serious, so I did my choice. Now, I dont care if it's redistributed or not, the flash intro have my username in it, and I guess rippers wont bother about modifing it. But I guess it's not the same problem for desktop customisers, it's probably issues about using elements of graphics, not redistibution.

But I dont believe that people dont know they cant use anything from net. They know it, but just dont care. No respect for others work anymore, that's it. At least, it's my point of view.

Speaking about this badge and my suggestion, well, you're probably right it would have opposite effect as first purpose. Well, it's more a way to express the angriness we can feel seeing themes ripped than a real effort to prevent ripping. In a funny way.

Btw, who answered me? You as CV, or as deviant?

If it was as CV, dont worry, Im not the kind of people insulting online. Especially on dA. That's just useless. Ignoring is painless, as devnull once told me.

Have you ever been ripped yourself?

OtisBee In reply to ShaolinAssassin [2011-09-14 22:17:20 +0000 UTC]

yeah, what you're experiencing with the mobile themes is happening for the CAD skins too. there's an app called XDeskCover (or XDC in short) and about 90% of the available XDC skins are actually CAD skins which have been ripped and converted into XDC compatibility. the original creators of said CAD skins have never been contacted nor asked for their permissions and often only found out about their work being ripped by coincidence (if at all).

rainmeter skins have recently suffered from the fact that a reasonable amount of the rather popular rainmeter skins have been used (while remaining unaltered) to add some malicious exe files and to then somewhat re-distribute them under a different name.

visual styles, winamp skins, or just about anything else that can be called a theme or a skin has been a victim of copyright infringement, so it isn't limited to just a handful of skin types.

in my opinion, that's the online world. just like in real life, there are criminals everywhere. and those are the guys i was referring to, when i said they violate a copyright deliberately.

well, what options do we have to make those evildoers stop what they're doing? is it wise to get into a discussion with them? highly unlikely, i guess. if it's happening here on deviantART, then there's the "report deviation" option, which functions in a timely manner, if a report was filed by the original creator of a deviation. it usually takes just up to a week before an incident gets resolved then.

and if my work gets ripped and then re-distributed on an off-deviantART location, then there's not many things i can do about it. personally, i add some details to the preview images of my skins, so that there always are some indicators that it was me who created the original. of course, it is still possible to just use one of my skins and then create another (new) screenshot and then use that as a preview image. but then again, this is just another evidence for the fact that if someone is really up to stealing something, then there isn't much i can do about it.

my button/badge won't prevent anybody from stealing my work, if that's what he's actually wanting to do.

the button is merely meant to inform people that i don't want my work to be used in other people's work.

and if there's someone who -despite of that badge- uses my work, then i will always be kind and polite when i then ask him to please delete it from his gallery again. and if this for whatever reason has no effect and if i would get some rudeness back in return, then i can still decide on what my next step will be. but one thing is for sure tho: i won't argue with someone about reason, if it shows clear that someone is totally immune to reason. it simply doesn't make sense to argue with someone who already has decided to remain being an asshole. every additional word of reason would be spent in vain then. and starting to also insult and threaten, won't bring me far either.

don't get me wrong here. i know exactly how it feels to get some artwork ripped by someone. it makes me feel angry, disappointed, sad, mad and what not. believe me, i have all the insults and bad names in my mind then. yes, i really hate the guy for quite some time. but when the first waves of rage have vanished, i finally start thinking more clearly again. i then can think about my options. before long i then realise that being rude and mean, won't take me anywhere.

if i put myself in the shoes of the guy who stole my work.... how would i feel if someone would be calling me names and would be all mean and insulting? would i apologize for what i did and maybe promise to never do it again? nah, i don't think so. i think i would definitely show that guy what he can do with his insults and names.

just think about it, the least thing what somebody expects who just stole someone's work, is that he gets treated with kindness and respect. besides, there's a good chance that this guy doesn't feel offended yet and is open to listen to what i have to say. rather than shutting off completely, you know. i know that this is no golden rule and often it doesn't work at all to be all nice and respectful. but then again, it will always be my first option. and thus far i managed to make everybody who ever stole something from me apologize to me.

btw.. it makes no difference whether i say this as a CV or as OtisBee the private person. i'm a kind person who treats everybody with respect and that has nothing to do with my title, status, position or whatever. that's just who i am.

and the devnull option is also a very powerfull one, which i use quite often myself.

in resume, if someone is only contacting you to get you angry, then you can't win if you do get angry, because that's exactly what that someone wants to see and nothing else. so, a nice option is to do the unexpected. like being understandable, kind, polite, patient and willing to listen for example. being insult-resistant so to speak.
or to not react at all, that's what's making them mad the most.

hmm.. i have no idea actually.
for quite some time now people are telling me that centering some text isn't working for them either.
but then again it seems to be a rather random issue, because for some people it works and for some it doesn't and that's in disregard to their subscriber status.

maybe it's a bug that comes and goes?

i have no idea really.
but you've tried using it without the "spaces" like i've mentioned in my description, right?
