If we get technical, you could say the antagonists were the ones to offer a duel first by causing incidents. Youkai cause trouble and humans solve them, as the rules say.

I can only assume Reimu being the one who actually enforces the rules can just call them off if it's a big enough threat. Like how in real life countries with strict weapon bans still issue guns to police officers.
