oklahoma box turtles are everywhere. most of em are used to getting picked up cause they always end up in driveways or roads and soo cute. you justt have to pick em up. just make sure you point their tail down and away from you. they tend to pee. YAY TURTLES

You are right, a tortoise is on land and a turtle is in water. However, I think this one is as =reachthetop says, a box turtle. It's appearance and description fits that of the common box turtle, especially b/c it had a hinged flap of its shell on the bottom to allow for further protection.

Not necessarily, some turtles have feet like a tortoise. Now, I'm not sure if this is or isn't a tortoise, I'm just saying that it quite possibly has a chance of being or not being a turtle or tortoise.
