I think more information is needed before a  ruling can be made if they were in the right to fire this woman

For example was her name and/or employment displayed on the blog? If so I think the decision was reasonible since in that case a basic google search could lead to a big snafu.

Ex. Joe Doe works for lets say Disney, he's even in a position where he gets lots of exposure to the public and or other buisnesses. So Amy Smith wanting to find out more about Joe Doe maybe for a report or just basic background searches for more info. Amy finds Joe's Blog because it says JOE DOE'S BLOG I work for Disney! and then has porn for Disney, Dreamworks, Pixar, ect

...yeah thats not gonna be good for the company

On the other hand if  the blog was instead "MADDOGS BLOG! I'm an artist!" and had no personal information for Joe Doe then I see no reason they should be fired.

I suppose once the company was made aware of the connection they had the choice to either turn a blind eye or take action : (

Yeah
Also pretty sure jobs like this have contracts stipulating that the employee basicly never make the company look bad be it professionally or personally.

Cor blimey, she must have had you when she was young...

PlayfulElegy [2016-08-08 01:15:52 +0000 UTC]

It's dependent. If her activities in her free time can easily be traced back to her (IE being an easy search check via name recognition), then her position in a public-facing position (likely PR) can have negative impacts. However, if it is not actively traceable back to her, she has every right to do it without risk of firing, due to privacy rights in that regard.

However, we also live in america, and most companies have the right to at-will termination, meaning they can fire you for any reason that isn't discrimination of an intrinsic value of yourself (or your religious beliefs), meaning that they don't have to justify the firing in any capacity regardless if people feel it is morally justified or no.

👍: 0 ⏩: 1

Cuddlepug In reply to PlayfulElegy [2016-08-08 06:13:27 +0000 UTC]

That sounds like a severe system in the US - do you personally think it's worth the risk?

👍: 0 ⏩: 1

PlayfulElegy In reply to Cuddlepug [2016-08-08 06:20:33 +0000 UTC]

It's an unfortunate necessity. Without at will, unless an employer openly provides specific reasoning for firing, it means they can be open to litigation for doing things such as downsizing. However, employees are still protected on the grounds that if they can prove that they're being discriminated against for sex, race, or religion; they can file suit. It's a delicate balance between respecting an individual's right to choose whom they associate with, and other individuals' rights to not be discriminated.

I'd say something similar happened to a friend of mine, but we all know when someone says something like that, they're probably talking about themselves. Bottom line, don't show your boss the porn you made for your Deviantart of the Cutie Mark Crusaders, Equestria Girls style, if you work at a daycare.

(He was digging the upskirt Cheerilie content, though. Of course, this is most likely just hear-say)

Rainbow-Skybird [2016-08-07 23:53:11 +0000 UTC]

Given this scenario, I think companies do have a right to decide this kind of thing. I don't know how they would have found her blog, but if they would have found it as easily as the story tells, then it probably means it could have been easily found period. Plus if she were working for a children's entertainment brand, and was drawing porn of a cartoon directed at a child audience (even though everyone can enjoy it), then it can damage a company's reputation.

Whether they personally agree anyone can enjoy what they want in their spare time or not, a company's image is very important if they want to thrive. So sadly choices do have to be made. It's either keep her at the risk of losing business from the controversy, or let her go and keep their customers.

I personally have no issues with porn stuff, but in this case it is the right of the company to decide if she's a proper representative of them or not.

Nice story though!

So let me get this straight: This lady's dream job is to work at a children's entertainment business, and she thought making porn of children's entertainment and showing it around was completely fine? That's delusional, to say the least. Her employer said it better than I can. There's just no way to uphold your company values with that stuff going on in your workforce. Do whatever you want in your spare time, but don't make the company look bad.

R-no71 In reply to ??? [2016-08-07 21:45:57 +0000 UTC]

You basically want to be careful with your porn interests displayed on the internet when you work / intend to work for the entertainment industry and even more if your work is aimed at children. You of course have the freedom to have such hobbies but it is best to do those with an "undercover" name and to avoid any connection with your actual name as much as possible so that employers googleing it won't stumble upon things they don't wanna see. Although it might sound unfair, it is understandable that this company took this decision, given the circumstances. I just hope that the name of this girl won't be spread around too much so she can get another similar job elsewhere and keep going forward.

Cuddlepug In reply to R-no71 [2016-08-07 21:47:42 +0000 UTC]

You make a good point - so it's OK to do this stuff if you use a pseudonym but not if you use your actual name?

👍: 0 ⏩: 1

R-no71 In reply to Cuddlepug [2016-08-07 22:01:05 +0000 UTC]

I'd say that it's better to use a pseudonym so that you can basically keep all your chances to work to any company related to entertainment, if your wish is to apply for a job in this field one day. However if drawing is a pure hobby for you, or if you want to be a "professional porn artist" and have the certitude that you won't want to get a job for a children show any day, then I suppose that you can keep using your actual name if you decide so

Cuddlepug In reply to R-no71 [2016-08-07 22:09:33 +0000 UTC]

Do you think it's realistic  to want to be able to openly draw porn as well as work in children's entertainment?

👍: 0 ⏩: 1

R-no71 In reply to Cuddlepug [2016-08-07 22:18:39 +0000 UTC]

Yes but just like the story showed that remains risky. Your boss won't want your porn to potentially make a connection with their company and so they might decide to tell you Goodbye to protect their image :')

If the company was a family friendly and wholesome family company then yes she deserved to get canned. Some shit should just be buried ten feet under and left for privacy. To me it sounds like she broke her contract by hosting an R rated blog that could otherwise damage young minds if they wanted to see what employees do on social media.

👍: 0 ⏩: 1

Cuddlepug In reply to KashimusPrime [2016-08-07 21:46:01 +0000 UTC]

This sounds like a fair assessment of the situation! Do you think she should appeal for her job or that her termination was fair enough?

👍: 0 ⏩: 1

KashimusPrime In reply to Cuddlepug [2016-08-07 21:48:32 +0000 UTC]

She should've read her contract and known that if they found out that she ran such a blog that she should've stopped running it if she wanted to keep her job. Companies like this have their reasons to be perfectly honest. I feel her termination was fair enough since if it was indeed in her contract not to do anything that would other wise ruin the company's visual(Such as running a porn blog featuring pastel colored horses) in public that yes they had the right to terminate her.

i think they were in the right in getting rid of her to protect the company reputation, I too had that happen where i got let go for threatening the company reputation but it was over matters of cleanliness and my own personal negligence that caused me to be let go although i did manage to get rehired because they realized i couldn't be replaced as an employee

Ehh... I'm back and forth about this. I feel like it's in a bit of gray area. I feel like a company shouldn't be able to fire someone based on what they do in their personal free time unless it is detrimental to the face of the company. However, this woman was apparently a representative of the company, so her actions could reflect on the company, so I'm inclined to stand by the company's decision. I'm still in the dark as to how they found OUT it was her blog. If she puts her real name to something like that, she's an idiot. This is exactly why I separate my nsfw stuff from my main account and have zero things other than word of mouth linking the two.

👍: 0 ⏩: 1

Cuddlepug In reply to equinepalette [2016-08-07 20:07:17 +0000 UTC]

In this particular case there may have been a clause in the contract forbidding this kind of content.

Do you do NSFW MLP stuff or is it humans or?

equinepalette In reply to Cuddlepug [2016-08-08 03:13:22 +0000 UTC]

Very true. There usually is when you're part of PR.

I do NSFW MLP stuff. Though I have done nude humans, it was part of a figure drawing class, not porn, necessarily.
